Co, party of the first part and The DSS&A Ry., Co., party of the second part, Witnesseth, Whereas the party of the first part by an instrument dated March 28, 1885, duly sold to the MH&O RR. Co., all its property of every name, nature and description whatsoever and wheresoever situated except its franchise to be a corporation, and also all its capital stock: And, Whereas, the party of the first part duly conveyed to the ME&O by an Indenture dated April 1, 1885, and Whereas the said MH&O has sold all of its property including that conveyed to it by the party of the first part to The DSS&A, and the party of the first part has consented to such sale and has agreed to re- lease and quit claim all its rights, title and interest in and to the said MH&O, Now, therefore, this Indenture Witnesseth: That in consider- ation of the premises and $1 paid by the party of the second part, the party of the first part has released and quit-claimed to The DSS&A, party of the second part hereto, all its rights, title and interest in and to the property conveyed by the said MH&O to the party of the second part by an instrument bearing even date herewith, including all the property heretofore or any time be- longing to the party of the first part and conveyed and trans- ferred or intended to be sold and conveyed or transferred by it to the said MHRO, subject, however, to all liens and encumbrances existing thereon at the time of such conveyance, hereby ratifying and confirming the said sale in all respects.
