MINUTES OF THE MEETING of the BOARD OF TRUSTEES July 17, 1970 Present: Chairman Stevens, Vice Chairman Merriman, Trustees Hartman, Huff, Martin, Nisbet, Thompson, and White; President Wharton, Vice President Wilkinson, and Executive Vice President and Secretary Breslin. Also present: Assistant to the President Ballard, Provost Cantlon, Attorney Carr, Vice President Dickerson, Vice President Muelder, and Vice President Perrin. Absent: No one. JThe Board convened in the Board Room at 10:23 a.m. - President Wharton presiding. A motion was made by Mr. Nisbet, seconded by Dr. Martin, to approve the June 19 minutes. Trustee Stevens asked that the following correction be inserted in Item 9 of the June 19 Finance Committee minutes: Statement by Trustee Stevens re review of Academic Freedom Report "Before voting on the original motion, after the amendment that the review be conducted in a meeting open to the public and the press lost, I made the follow- ing statement: That I did not oppose a review of the Academic Freedom Report, but that I was voting against the motion because I did oppose having this review con- ducted in a secret closed meeting and that I was opposed to amending this document without following the procedures as outlined in Article 7 and adopted by the Board of Trustees unanimously on March 16., 1967." By unanimous vote, the June 19 minutes were approved as corrected. The Secretary, during a review of the June Finance Committee minutes, noted a suggestion by President Wharton relative to Item 9 had been overlooked. This action should also show that jafter discussion the President suggested that since the Trustees had not received the pro- Iposed revisions of Article 6 of the Academic Freedom Report until the day of the meeting, •'that they were being given to them for discussion and later action. ISPECIAL MISCELLANEOUS Request for funds for Day Care Centers ; 1. On motion by Mr. Thompson, seconded by Mr. Stevens, it was unanimously voted to approve ; the Finance items on the preceding pages. 2. A small group of women, children, and men, representing women1s liberation organiza- tions, women student s3 and student wives, asked for permission to present their request for day care centers in married housing to the Trustees. Mrs. Penny Olson and Mrs. Cynthia Cole, spokesmen for the group, asked for space and funds for staff and equipment for these facilities. It was explained that eventually the centers would be self-supporting but at the present time seed money was required. At Dr. Dickerson1s suggestion, Dr. Robert P. Boger, Director of the Family-Child Study Center, was asked to present the proposals prepared by the Coalition Committee for Day Care to the Trustees at the July 17 luncheon. ! | ! I : A. Trustees Martin, Merriman, Nisbet, Stevens, and Thompson voted nYes,ff Trustees Hartman, Huff, and White voted nN6.rf (See page 6826) Before the vote was taken, Trustee Huff proposed that the faculty salaries be raised 8.5 percent rather than the average of 7.8 percent and that the increases might be made effec- tive September or October rather than July 1. He also suggested several ways that the University might be able to cut expenses. He mentioned the large number of institutes held on campus and the many university publications, and wondered if some of them might be elim- inated. He also suggested that graduate fees and some other fees might be increased and said that fund raising efforts should be stepped up. He also felt a management firm should be employed to review the University operation. Stevens stated that an 8.5 percent increase over an 8 or 10 month period would not be 8.5 percent but probably something under 7 percent when figured for the entire fiscal year starting July 1. He also commented that if we were to start 2 or 3 months late this year in the effective date of the faculty salary increases that we would have no assurance that someone might not propose next year and the year after that we continue this policy of delaying the start of annual increases to the point where in 4 to 5 years the faculty could lose one whole year in salary increases. 2. OTHER ITEMS, continued July 17, 1970 5, Water Quality Improvement Facility, continued Action on Hearing Pro- cedure for AP employees delayed The committee recommended employing Johnson & Anderson, Inc. from Pontiac for first consideration. The committee feels this firm is quite capable of handling this project. They are experienced in the type of engineering this will require, particularly in the lake development. The firm is presently doing work at Oakland University and has completed designs for ecological ponds at the Kellogg Biological Station, in addition to numerous other major projects throughout the state. The second choice would be Williams & Works from Grand Rapids. They have not had any work at MSU but they are a large firm doing projects for many municipalities in Michigan. The third choice would be Capitol Consultants from Lansing. This is a small firm doing a considerable amount of work in the central Michigan area. On motion by Mr. Nisbet, seconded by Dr. Martin, it was unanimously voted to approve the selection of Johnson & Anderson, Inc. as the consulting engineer for the Water Quality Improve- ment Facility. 6. Executive Vice President Breslin recommended the approval of the following hearing procedure for Administrative-Professional employees. HEARING PROCEDURE ADMINISTRATIVE PROFESSIONAL EMPLOYEES An Administrative-Professional employee who has completed one year of regular full time continuous employment shall not be discharged, demoted or suspended except for reasonable and just cause, and only after consultation with the administrative head who is responsible for such action. The following hearing procedure may be utilized by an Administrative-Professional employee who feels that he has been unfairly discharged, demoted or suspended. I. APPEAL HEARING Section 1. The employee who wishes to invoke the hearing procedure must notify the Director of Personnel in writing within five (5) working days of the date he received notification of his discharge, demotion or suspension that he wishes to appeal the action taken. Section 2. The Director of Personnel will arrange, within five (5) working days from his receipt of the written appeal, a meeting with the employee, a member of the Administrative-Professional Association, if requested by the employee to be selected by him, and the administrative head of the department involved or his designated representative to review the action taken and to determine its validity. Section 3. Within five (5) working days following the meeting the Director of Personnel will render his written decision by mail to the parties concerned and instruct them of the action to be taken. Notification by mail to the employee will be to the last known address as reflected on his personnel records. II. HEARING BOARD Section 1. If the employee is not satisfied with the decision of the Director of Personnel he may appeal the decision to a Hearing Board. The appeal shall be in writing and shall'be submitted to the Director of Personnel within five (5) working days from the date of the employeeTs receipt of the mailing of the decision rendered by the Director of Personnel. Section 2. The Hearing Board shall consist of (a) two members from the Administrative- Professional Association which the employee shall select from a list of twelve (12) names provided by the Association and (b) two non-Administrative-Professional members selected by the Executive Vice President of the University. The Executive Vice President shall also designate one of the Hearing Board members as chairman. Persons employed in the Personnel Office or in the employee's department may not serve as members of the Hearing Board. Section 3. The Hearing Board shall be convened within ten (10) working days from the date of receipt by the Director of Personnel of the employeeTs written appeal and shall conduct a hearing to examine the case and to determine whether the employee has been treated in an equitable manner. Section 4. The meeting of the Hearing Board will be closed and confidential. Section 5. The parties may call witnesses who shall give sworn testimony. Section 6. The Hearing Board shall render its findings and mail to the parties concerned within five (5) working days after the date of the hearing. If the employee is not satisfied with the decision of the Hearing Board he may appeal the decision to arbitration. The appeal shall be in writing and shall be submitted to the Director of Personnel within five (5) working days from the employee's receipt of the mailing of the Hearing Board. From a list of five (5) arbitrators, one that is acceptable to both parties will be selected. In the event they cannot agree upon an arbitrator within five (5) working days, the arbitrator shall be selected by the American Arbitration Association. The Director of Personnel !•:-:•••:• shall immediately contact the American Arbitration Association for the appointment of an arbitrator• The Arbitration Hearing shall be held at the earliest possible date. Section 2. The Arbitration Hearing will be closed and confidential• Section 3. The rules of the American Arbitration Association shall apply to the hearings Section 4, The Arbitrator's written decision shall be rendered and mailed to the parties concerned. The decision will be binding on all parties. Section 5. The fees and authorized expenses of the arbitrator shall be equally shared by the University and the employee, and in the event of a decision reinstating the employee, all costs will be paid by the University. IV. REINSTATEMENT Should a decision be rendered at any step of the Hearing Procedure that the employee was unjustly discharged, demoted or suspended without reasonable and just cause, the University agrees to immediately reinstate the employee in his former position effective the date of the discharge, demotion or suspension without loss of any employment status, wages and benefits. NOTE: References in the above procedure to the Director of Personnel should read "Director of Personnel or his representative." Motion was made by Mr. Hartman, seconded by Mr. Stevens, to approve the Hearing Procedure for AP employees, Several of the Trustees stated they did not receive the minutes in time to study this proposal and therefore Trustee Hartman moved, seconded by Mr. Huff, that the matter be tabled until the September Board meeting. A motion was made by Mr. Stevens, seconded by Dr. Martin, to request the establishment of a student/faculty committee to review the operation of the Academic Freedom Report since its adoption, March 16, 1967, this committee to be chosen by ASMSU and the Academic Council in accordance with their established procedures with any recommendation for change to be presented to the Trustees in accordance with the procedure as outlined in Article 7 of the Academic Freedom Report.
