Section 1.00- Statement of Purpose .01 It a ppearin g to the Board of Trustees of Michi ga n State University - that regulations for the care, prese rvatio n and p rotectio n of th e p roperty g·ove rn ed by th e Board a nd for co ntrol of th e co ndu ct of th ose on said p rop erty are essentia l to secure th e successfu l operation of the Un iversity, main tain good order, p romote the designed obj ecti ves of the Univers ity, a nd to obviate unn ecessary and improper inte rfe re nces with University activities and the lawful activities of those coming upo n land gov e rn ed by the Board, th e Board her eby adopts the fo llowi ng provisions : 2.00- Effectiveness of Ordinance .01 . 02 . 03 . 04 - T his ordinance shall be effective at 12:01 a.m. , September 15, I 964 . - All ord inan ces previously enacted by the State Board of Agriculture are he reby declared null a nd vo id . - An y exce ptions to the fo llowing secti o ns of this ordinance mu st be made by writte n a uthori zatio n o f the office of the Secretary of th e Board of Trus tees for Michigan State University: 9.0 1, 12.01 , 14.0 1, 20.01 , 23.01, 26.01 , 29.0], 30.01, 30.0 2, 3 1.01, 31.03, 39 .1 44 and 40.14 . - T he provisio ns of thi s ord ina nce shall not apply to the sa le or d istri butio n o f stude nt pub li catio ns except that the method of distribution sha ll not. interfere with norma l uni vers ity functions. 3.00-Authority of Board of Trustees .01 - This ord inance is enacted by the Board of Trustees pursua nt to an d in accord a nce with the a uthority and res po nsibi lity of sa id Boa rd as o utlined in the Co nstitu tion of the State of Michiga n, Public Act 80 of 1905, as ame nd ed , and Public Act 269 of 1909, as a me nded . 13 4.00 4.00- Designation of Enforcement Powers .01 . 02 . 03 - Pursuant to the authority stated in Section 3.01, th e Board of T rustees does h ereby entrust the Director of the Department of Public Safet y of Michigan State University with the duty of e nforcing thi s ordinance . - T he Director o f the Department of Public Safety o f Michigan State Un i versity is also charged with the responsibili ty to appo in t subordinates wh o shall , a mo ng other things , be employed to e nforce this ordinance . - When for the purpose of maintaining necessa ry co ntrol o f property governed by the Board of Trustees located in areas beyond the property at or adj acen t to East Lansing, and th e co nduct of persons co ming onto this property, the Board m ay a uthori ze the a pplication of th is ord inance or portio ns of this ord inan ce to said prope rty. Enforce ment auth o rity ma y be ves ted with appropriate loca l officials. 5.00- Duties of Public Safety Officers - Every such person , duly a ppointed , shall apprehend and arrest a ny person in violation of an y prov ision of this ordinance and sha ll make compla in t aga inst such violator before any judge having jurisdiction; sha ll restrict access to a ny a rea for th e protection o f an individua l, crim e scene, or public safety or convenience; is empowered to d e legate to any citizen or peace officer any part or all of his authority to enforce any part or a ll o f the provisions of this ord inance wh e n the citize n or peace officer is acting in conjunctio n with the public safety officer; shall inspect the properties un der control of the Board and establish the id entity of those persons found upon the premises after hours or in unusu a l circumstances; may ejec t from the property under co ntrol of th e Board any perso n unable to establish his right upon th e property; shall ta ke into custody a n y property that appears to be lost, stolen or aba ndon ed; shall cause to be towed and /or impounded any motor vehicle or bicycl e pa rked contra ry to the provisions of the ordinance whe n th e veh icl e is ca using dam age, is pa 1·ked upon a lawn or crop area, is obs tructing normal movement of the public o r univer sity operations or is in violation of the provisions of th is ordinance ; sha ll take into protective custod y a ny student appea ring to be m enta ll y disturb ed until such student ca n be placed into the care of U ni versity H ealth Center personnel for diagnosis and disposition; shall take into custody any animal found running loose upon property und er control of the Board until the animal can be returned to its owner or p laced in custod y of an a nimal shelter ; shall destroy a n y animal runnin g loose upon prope rty under co ntrol of the Board if un a ble to capture it; shall take ca re to ensu re the safe ty and convenience of all persons coming onto prope rty under control of the Board and shall a rrest any person who, without prop er authority, interferes with or o bstructs the right of a n y person to m ove abou t th e property in accordance with this ord inance and established rul es and regu lations; shall be diligent to secure respect for and protection o f the civil ri ghts of all persons ; may eject from prop erty under control of the Board a ny person not complying with esta blished ru les and regulations even if th e ru les and regu lations are not enforceable under this ordi nance; shall ensure by im med iate rem edia l measures if necessa ry the safety of persons and property at any event h eld o n property under co ntrol of the Board. .01 14 5.02 .02 It shall be the duty of the Director of the Department of Public Safety or his authorized subordinates to establish temporary restrictions upon access to or use of University buildings, parking lots, streets and highways or other property of the University or portions thereof as may be deemed necessary or desirable for the convenient and efficient cond uct of the affairs of the University; provided that the Director of the Department of Public Safety or his au thorized representatives shall make such restrictions known by use of signs, barricades, announcements, posting of police officers or other authorized persons possessing official id entification , or establishing police lines beyond which unauthorized persons are not per mitted to pass. 6.00- Misdemeanor- Penalty .01 - Whosoever shall refuse or fai l to co nform to such rules or regulations, which may be prescribed by said Board in this ordinance, shall be deemed guilty of a misdemeanor, and upon conviction thereof may be fined and/or imprisoned in the county jai l of the cou nty wherein the offense was com mitted, as provided by law . 7.00-Posting of Ordinances .01 - Copies of this ord inance, and all subsequent amendments thereto, shall be maintained, in convenient form , in a t least three (3) conspicuo us places on the lands governed by said Board. 8.00- Definitions .01 . 02 .03 . 04 . 05 . 06 . 07 . 08 .09 - T he term "ordinance" shall encompass only those rules and regula tions hereinafter prescribed . - The term "the Board" shall be considered syno nymous with the terms " the State Board o f Agriculture" and "the Board of Trustees of Michiga n State University." - The term "Act 80" shall refer only to State of Michigan Public Act 80 of 1905, as amended . - The term "Public Safety Officer" shall include all ranks within the or ganizational framework of the Department of Public Safety of Michigan State Un ivers ity and shall be considered synonymous with any other d es criptive title normally assigned to those persons entrusted with the exercis ing of police powers . - The singular number, as used in this ordinance, includes the plura l and the plural includes the singular . - The masculine gender, as used in this ordinance, includes the fe minine and neuter genders . - The terms "person," "accused," and similar words include, un less a contrary intention appears, public a nd private corporations, co-partner ships, and unincorporated or voluntar y associations . - The term "act" or "doing of an act" includes "omission to act." - T he word "property" includes any matter or thing upon or in respect to which any offense may be comm itted. 15 8.10 .10 .11 - The term "writing," "written," and any item of like import includes words or pictures printed, painted, engraved, lithographed , photographed or otherwise copied, traced or made visible to the human eye in any manner whatsoever. - The term "campus" as used in this ordinance shall be construed to in clude all property wheresoever situated , owned or held by the Board of Trustees in its capacity as the governing board of Michigan State University. 9.00-Aircraft .01 - No person shall land airplanes or helicopters except on the landing strip provided for that purpose. I 0.00-Athletic Equipment .01 - No person shall use athletic equipm ent or other equ ipment or materials in a careless manner so as to endanger life or property or to disturb the peace of individuals within the area. 11.00-Bicycles-Illegal Taking .01 . 02 - No person shall take or use a bicycle without the a uthority of the owner . - No person shall willfully or knowingly assist or be a party to the un authorized taking of a bicycle. 12.00- Boating .01 - No person shall operate a boat propelled by a motor on the Red Cedar River, or any other body of water, contiguous to or contained within any property under control of the Board of Trustees. 13.00-Buildings .01 . 02 - The Secretary of the Trustees of Michigan State University is hereby empowered to establish regulations restricting or prohibiting access to and/or use of University buildings and property by employees and students of the University and by members of the general public when such regula tions are deemed· desirable for the convenient and efficient cond uct of the affairs of the University or for the management and protection of its prop erty; provided such regulations must be posted at the entrances to the fa cility or portion of the facility or building affected . - No person or persons shall willfully destroy or damage or in any manner deface, destroy, or injure any property not his own, o r any public building, bridge, fire hydrant, alarm box, street light, street sign, or shade tree belonging to Michigan State University, or mark o r post hand bills on or in any manner mar the walls of any public building, or any fence, tree , or pole within the confines of Michigan State University, or take, or meddle with any property belonging to Michigan State University or re move the same from the building or place where it may be kept, placed, standing, or stored, without authority from the Secretary of the Board of Trustees or his designated agent. 16 14:00 14.00-Camping .01 - No person shall construct or otherwise erect, or abide in any lean-to, vehicle, trailer, tent, or other temporary shelter facility anywhere within the confines of land governed by the Board. 15.00- Counterfeiting, Altering and Copying .01 . 02 . 03 - No person or persons with intent to injure or defraud shall falsely make, forge, manufacture, print, reproduce, copy, tamper with, or alter, any writing, record, document or identification used or maintained by Michigan State University . - No person or persons shall knowingly possess, display or cause or permit to be displayed any writing, record, document or identification form used or maintained by Michigan State University knowing the same to be ficti tious, altered, forged, counterfeited or made without proper authority . - No person or persons without proper authority shall knowingly possess, make, or cause to be made, any key, card, or unlocking device, to operate any lock or locking mechanism used or maintained by Michigan State University. 16.00-Disorderly Assemblages or Conduct .01 . 02 . 03 - No person or persons shall, without authorization, assemble together anywhere on the campus for the purpose of creating any noise or disturb ance, riot, raid or other improper diversion, or assemble in a manner which obstructs the free movement of persons about the campus or the free and normal use of University buildings and facilities, or prevents or obstructs the normal operations of the University . - No person or persons shall disrupt the normal operation of any proper ly authorized class, laboratory, seminar, examination, field trip or other educational activity of the University . - No person or persons shall disrupt the normal use of any campus building or area which has been assigned or scheduled through appro priate channels for educational or extracurricular activities. Included with in, but not limited to the foregoing, is the use of appropriate buildings or areas for dramatic or musical presentations, lectures, athletic events, mili tary exercises, orientation meetings, registration, commencement ceremo nies, and placement activities . . 05 . 06 . 04 - No person or persons shall disrupt the normal activity or molest the property of any person, firm or agency while that person, firm or agency is carrying out the provisions of a contract or agreement with the University . - No unauthorized person or persons shall enter upon the playing area of any athletic contest or exhibition while said contest or exhibition is in progress . - No person or persons shall project or drop any object which could cause injury, damage or interference in the spectator or playing area where any athletic contest or exhibition is conducted . - No person shall enter or attempt to enter into any dance or social, athletic, theatrical or other public event without a ticket of admission to such event when such tickets are required, or enter or attempt to enter contrary to any established rules or qualifications for eligibility for attend ance at such events as provided by the sponsors. No person ineligible to attend such events shall loiter about the premises where such an event is being held. . 07 17 17.00-Dumping .01 - No person shall deposit, dump or othe rwise dispose o f refuse of an y kind on Michigan State University property. 18.00- Examinations .01 . 02 . 03 - No person or persons shall take, steal, or otherwise procure in any un authorized manner an y piece or pieces of writing which, as can be shown by competent authority, contain the questions or answers to an examination scheduled to be given, at some subsequent date, to any individual or group enrolled in any course of study offered by Michigan State University . - No person or persons shall sell, give away, lend or otherwise furnish to any unauthorized individual any piece or pieces of writing which, as can be shown by competent authority, contain the questions or answers to an examination scheduled to be given, at some subsequent date, to any indi vidual or group enrolled in any course of study offered by Michiga n State University . - The unauthorized possession of any of the aforesaid writings shall be considered prima facie evidence of an attempt to violate the provisions of this section. 19.00- Firearms or Weapons .01 . 02 . 03 . 04 - No person shall possess any firearm or weapon anywhere upon the lands governed by said Board: Provided, however, that the provisions hereof shall not apply to such possession within the residences of those persons lawfully residing in the married housing facilities of the campus who fulfill all applicable requirements of the state statutes pertaining there to . - No person shall possess any chemical, or other dangerous substa nce or compound, with the intent of using the same to injure, molest or coerce another, anywhere upon the lands governed by the Board . - The use of any such device is prohibited anywhere upon the lands governed by the Board except those areas specifically set aside and super vised as range facilities, or as part of the regular educational process . - The provisions of this section shall not apply to the sworn police officers employed by the Department of Public Safety and other legally established law enforcement agencies. 20.00- Fires .01 - It shall be unlawful for any person or persons to set a fire upon the lands governed by said Board except in approved stoves amd grills in designated picnic areas or as required by University personnel in the dump area. 21.00- Loitering .01 - No person shall loiter or trespass in any building, construction area, building under construction, street, tunnel, rest rooms or sleeping room areas of persons of the opposite sex or area where he is not assigned for living, work, organized recreation or study purposes. 18 23.02 .02 . 03 - No minor under the age of 17 years shall loiter, idle, or congregate in or on any public street, highway, alley, park or public building between the hours of 10 o'clock p.m. and 7 o'clock a.m. unless the minor is accom panied by a parent or guardian or some adult delegated by the parent or guardian to accompany the child . - Any person of the age of 17 years or over assisting, aiding, abetting, allowing, permitting or encouraging any child under the age of 17 years to violate the provisions of Section 21.02 shall be in violation of this Ordi nance. 22.00-Liquor .01 - No person shall possess or consume alcoholic beverages of any kind anywhere within the confines of land governed by said Board: Provided, however , that the prohibitions of this section shall not apply to possession or consumption by the residents and their guests, who, having attained the age of 21 years , possess or consume alCoholic beverages in their married housing facilities provided by Michigan State University. 23.00- Model Airplanes .01 - No person shall fly model airplanes except in areas designated for that purpose. 24.00- Molesting .01 - No person shall accost, molest, or otherwise annoy, by word of mouth, whistle, sign or motion any person upon the lands governed by the Board. 25.00-Pets .01 . 02 - No person owning or having under his control a dog, cat or any other animal shall permit such animal to be upon the property of Michigan State University without a leash suitably attached to said animal so as to restrain its movements, unless said animal is confined within a suitable enclosure sufficient to restrain its movements to the area of said enclosure . - The purposeful breeding of dogs, cats and other animals anywhere upon the lands governed by said Board is prohibited except where such breeding is an activity carried on in academic areas and subject to the direc tion and control of members of the faculty of Michigan State University. 26.00- Picnicking .01 - No person shall picnic on Michigan State University property in areas not designated and posted as picnic areas. Non-University groups of 25 or more must have written approval to use the facilities in accord with Section 2.03. 27.00-Plant Materials .01 - It shall be unlawful for any person to break or cut branches or flowers or fruit, or otherwise mutilate, any tree, shrub or herbaceous plant or re move therefrom any identification sign or tag. 19 CERTIFICATION OF AMENDMENTS TO MICHIGAN STATE UNIVERSITY ORDINANCE I HEREBY CERTIFY that the following amend ments to the ordinance of Michigan State Univer sity were passed by the Board of Trustees at a meeting duly called and held at East Lansing, Michigan, on the 17 day of April, 1970, at which a quorum was present and voted, and that said amendments are duly recorded in the minutes book of the Board of Trustees. 22.00-Alcoholic Beverages JACK BRESLIN, SECRETARY May 26 , 1970 .01 - The use or possession of alcoholi c beverages, including be er and wine , subject to State law , is h ereby permitted in housing facilities (rooms, suites, and a partm ents) assigned by Michigan State University . . 02 - The use or possession of alcoholic beverages is expressly prohibited in classrooms, lectur e halls, laboratories, the librari es, the chapel a nd within buildings or arenas where athletic events, lec tures, and concerts are held . . 03 - The use of alcoholic be verages is ex pr essly prohibited in all public areas of campus buildings except as indi cated in Sections 22.04 and 22.05 below . . 04 - The use of alcoholi c bev erages at non-student social events, subject to State Ia w, is permitted in areas d esignated by, and with the approval of, the Office of the Secretary to the Board of Trustees . . 05 - The use of alcoholic beverages at student social events, subject to State law, is permitted in areas designated by, a nd with the approval of, the Office of the Vice President for Student Affairs. ( 28.00-Property: Lost, Found, Stolen or Abandoned .01 .02 .03 - It shall be the duty of the Director of the Department of Public Safety of Michigan State University to maintain an accounting of all moneys, goods, wares and merchandise deposited in his office as lost or abandoned property which has been found within the campus of said institution. On the first secular day in the months of January, April, July, and October in each year, or more often as necessary, said Director of the Department of Public Safety shall cause a notice of all such property as shall remain un claimed to be posted in four conspicuous places on said campus for three successive weeks to all persons interested or claiming such property: Pro vided, however, that if any of such goods, wares, merchandise or chattels shall be of a perishable nature or expensive to keep, then it shall be lawful for said Director of Public Safety to sell the same at public auction at such time and after such notice as sha ll to him and the Board seem proper. - It shall be the duty of the Director of the Department of Public Safety , on receiving satisfactory proof of ownership, to deliver such property to the owner thereof on payment of a ll necessary and reasonable expenses which may have been incurred in the recoverin g, preservation or sustenance of such property and the expense of advertising the same unless the Uni sity Attorney or the Prosecuting Attorney of the County of Ingham shall otherwise direct. - It shall be th e duty of th e Director of the Department of Public Safety to cause all property unclaimed after the expiration of the notice specified in Section I , money excepted, to be so ld at public auction to the highest bidder o r through normal sales procedures established by the University salvage ya rd , unless the Prosecuting Attorney of the County of In gham shall direct that it shall rema in unsold for a lon ger period to be used as evidence in the administration of justice; and the proceeds th ereo f shall be forthwith paid to the University's Business Office together with all money, if any, which shall remain in his hands after such notice as aforesaid, first deducting actual charges of said sale. 29.00- Property Removal .01 . 02 . 03 - No person shall remove any property from lands or buildings owned and operated by Michigan State Un iversity. Such property sha ll include books, films, docume nts, maps , charts, soil , plant material, construction materials, tools, vehicles, refuse or any other items having value or not that is owned by Michigan State University . - No person shall take o r remove property owned by or in custody of Michigan State University from the custody or control of the University department or agency responsible for its use and maintenance or to whose inventory it is assigned, without autho rization of the head of that depart ment or agency or his designated subordinates, or without following the regulations established by appropriate University authority for borrowing such property . - Th e use of University equipment or other property for other than Uni versity business is prohibited. 30.00- Selling and Advertising .01 - No person, firm or corporation shall engage in the business of selling, hawking, or peddling any goods, wares, merchandise or services, or take 20 30.01 . 02 orders or make contracts for the purchase or delivery thereof, either at the time or in the future, within the boundaries of Michigan State University . - No person shall erect or otherwise display, except on his personal property, any sign or poster or distribute handbills upon property gov erned by the Board which advertises or otherwise calls attention to any commercial product, service or activity. 31.00- Signs .01 . 02 . 03 - No person shall erect or otherwise display, except on bulletin boards erected by Michigan State University, any sign or poster advertising or otherwise calling attention to any person or activity of the students or staff of Michigan State University . - No person shall efface, alter, tamper with, destroy or remove any sign or inscription on any property governed by the said Board . - property other than a bulletin board governed by sa id Board. It shall be unlawful for any person to attach any sign or poster to any 32.00- Smoking - Smoking is hereby prohibited: .01 .011 - In barns and farm buildings except where specifically approved for smoking by the Director of the Department of Public Safety . . 012 - In and adjacent to all buildings used primarily for storage of com bustible materials and/or flammab le liquids; provided, however, that all build ings and areas other than classrooms shall be clearly posted as "No Smoking" areas. 33.00-Telephones .01 . 02 .03 It shall be un lawful for any person to telephone any other person re - peatedly for the sole purpose of harassing or molesting such other person or his family, whether or not conversation ensues . - It shall be unlawful for any person to use any threaten ing, vu lgar, indecent, obscene, immoral or insulting language over any telephone in strument or equipment. - It shall be unlawful to summon, as a joke or prank or otherwise, without any good reason thereof, by telephone or otherw ise, the police or the fire department or any public or private ambulance to go to any address where the service called for is not needed . 34.00-Traffi.c-Rights and Duties of Drivers and .01 Pedestrians - Traffic-control signals (legend). Whenever traffic is contro lled by traffic control signals, exhibiting d ifferent colored lights successively one at a time , or with arrows, the following colors shall be used and said lights sha ll in dicate and apply to drivers of vehicles and pedestrians as fo llows: .Oll - GREEN alone: Vehicular traffic fac ing the signa l may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turnin g right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfu lly with in the intersection or an adjacent crosswalk at the time such signal is exhibited. 21 34.012 .012 - GREEN a lone : Pedestrians fac ing the signal may proceed across the roadway within any marked or unmarked crosswalk . . 013 - YELLOW a lone (following a GREEN signal): Vehicular traffic facing the signa l sha ll stop before entering the nearest crosswa lk at the intersection, but if such stop ca nn ot be made in safety, a vehicle may be driven ca utiou sly through the inte rsection . . 014 - YELLOW a lo ne (fo llowin g a GREEN signa l): Pedestr ians faci ng such signa l are hereby advised that there is insuffici e nt time to cross the roadway, a nd an y pedestrian the n startin g to cross sh all yie ld th e right-of-way to a ll vehicles . . 015 - RED alo ne : Vehicul ar traffic fac in g the signa l sha ll stop before entering the nearest crosswa lk at an intersection or at suc h other point as may be indi cated by a clearl y visible lin e and shall remain standing until green is shown a lone . . 016 - RED a lone: No pedestr ian rac ing such signal shall enter the street u n less he can do so safe ly a nd witho ut inte r fer in g with a n y veh icular traffic. .017 - GREEN A RROW (steady): Ve hi cu la r tralf,c fac in g such signa l ma y ca utious ly e n te r the in te rsection o nl y to make t.he movement indicated by such arrow but sha ll yie ld th e r ig h t-of-wa y to pedestr ians lawfull y with in a crosswalk and to other traffic lawfu ll y us in g the intersectio n . . 018 - RED ARROW (flashing): Whe n a RED ARROW is illuminated by rapid interm ittent fl as hes, drivers of ve hicles sha ll stop before e nte ring the nearest crosswa lk at an inte rsectio n or at a limit line when marked, and shall th en be privi leged to make the move ment in d icated , provided that no inter ference is offered ped estrians or veh icles lawfu ll y o n the street. .02 .019 - RED ARROW (fl as hin g) : No pedestria n fac in g such sig nal sha ll e nter the street unless he ca n do so safely and withou t in terferin g with any vehicu lar traffic. - In the eve nt a traffic-control signa l is e rected and maintained at a p lace other tha n an intersection , th e provisions of this sectio n shall be app licable excep t as to those p rovisions which by their nature can have no application. T he foregoing requirements shall app ly when: - A clearly visible and positive signal gives warning of the immediate approach of a railway train or car; - A crossing gate is lowe red or when a Aagm an gives or continues to give a signal of the approach or passage of a railroad train; - A railroad train approaching within approximate ly 1500 feet of the highway crossing e mits a signal audible from such distance and such railroad train, by reason of its speed or nea rn ess to such crossin g, is an imm ediate hazard; - An approaching railroad train is plainly visible and is in hazardous proximity to such cross ing; - No person shall drive any vehicle through, around, or under any cross mg gate or barrier at a ra1lt oad grade crossing while such gate or barrier is closed or is being opened or closed. - Stop signs: When stop signs a re erected at or nea·r the entrance to any intersection , every driver of a vehicle shall stop such vehicle at such sign or at a clearl y marked stop lin e, except when directed to proceed by a pub li c safety officer or traff,c-contro l signal and shall proceed into the in ter section only when such movement can be made in safety and without inter fering with other traffic. - Emerging from a lley, private road or driveway: The driver of a veh icl e about to ente r or cross a highway from an alley, private road or driveway sha ll come to a full stop and yield righ t-of-way to a ll vehicles or pedestrians approaching on said highway so close to such point of entry as to constitute an immediate hazard . - Obstructing intersection: Notwithstanding any traff,c-control signa l indication or oth er right to proceed, no driver shall enter an intersection or a marked crosswa lk unless there is sufficient space on the other side of th e intersection or crosswalk to accommodate his vehicle witho ut obstruct ing or blocking the passage of other vehicles or pedestrians . - Passing stopped ve hicl e at intersection: Whenever any veh icle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle. - Right-of-Way (at intersection), - When two vehicles enter an open intersection at approximate ly the same time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right. The driver of any vehicle traveling at an unlaw ful speed shall forfeit any right-of-way which he might otherwi se have hereunder; - Th e driver of a vehicle within an intersection intending to turn to the left shall yield the right-of-way to any vehicle approaching from the op posite direction which is within the intersection or so close thereto as to constitute an im mediate hazard, but said driver, having so yielded and hav ing given a signa l when and as required by this ordinance, may make such left turn and the drivers of a ll other vehicles approaching the intersection from said opposite direction shall yie ld the right-of-way to the ve hicl e mak ing the left turn: Provided, that at an intersection at which a traffic signal is located, a driver intending to make a left turn shall permit veh icles bound 23 ) 34.102 straight through in th e opposite directio n which are waiting a "Co" sig na l to pass through the intersection befo re making the turn ; .103 - When the intersection is design ated as a "Yie ld Right-of-W ay" inter section, the dri ver of a vehicle approac hing said sign shall slow to a reason a ble speed for existin g cond iti o ns of traffic a nd visibility, yielding the righ t of-way to all vehicles on the inte r sectin g stree t or hi g hwa y whi ch have entered th e intersection or are so close as to constitute an immedi ate haza rd. If a driver is invol ved in a collision at a n intersectio n or in terferes with th e moveme nt of other vehicles after failure to h eed a nd dri ving past a "Yield Right-of-Way" sign , such collisio n or interfer e nce shall be deem ed prim a facie eviden ce of the driver's fa ilure to yield ri g ht-of-way. 35.00-Driving in Roadway-Following, Overtaking and Passing .01 - Upon all roadways of suffic ie nt width a vehicle sha ll be driven upon the right half of th e roadway, and on highwa ys with four o r more lan es, within the extreme right h a nd lane, exce pt as follows: .011 - Whe n overtaking a nd passing another veh icle proceeding in the same direction und er the rul es gove rning such movement; .012 - When the right half of a roa dway is closed to tra ffi c while unde r co n struction or repair ; .013 - U pon a roadway di vided into three la nes for tr a ffi c und e r the rul es applica ble th ereo n ; .014 - Upon a roadwa y d es ignated and signposted for on e- way traffi c; .015 - Upon a roadway that h as a la ne marked and design ated for th e use o f . 02 .03 . 04 . 05 . 06 bicycl es . - Drive within mark ed traffic lane: It shall be a violation of this o rdinance for the opera to r of a n y vehicle to fail or refuse to keep such vehicle within the boundaries of an y legall y marked traffic la ne except when lawfull y passing another veh icl e or pr e parato r y to m a king a lawful turning m ove me nt. - Fo ll owing too close ly: The driver o f a motor vehicle sha ll not fo llow another vehicle more closel y th a n is reasonable a nd prudent, hav ing due regard for the speed of such veh icl es, a nd th e traffic upon and the condi tion of the streets . - Fo ll ow in g fire a ppa ra tus pro hibited : The dr iver of an y vehicle other th an a n a uthorized e me rgen cy vehicle o n official business shall not follow any fire apparatus trave ling in res ponse to a fire alarm cl ose r th an 500 feet or drive into or park such vehicle within 500 feet where fire apparatus has stopped in answer to a fire ala rm . - Passing ve hicl es proceeding in opposite directions: Drivers of ve hicles proceeding in opposite directio ns sha ll pass eac h other to th e right, a nd upon roadways havin g width fo r not more tha n o ne lane of traffic in each direction each driver shall give to the other at least one-half of the main trave led porti o n of th e roadway as nearl y as possible . - The following rules shall govern th e overtaking and passing of vehicles proceeding in the same directio n , subj ect to th ose limita tio ns , exce ptions, and special rul es hereinafter stated: .061 - The dri ver of an y veh icl e overtaking a noth er ve hicl e proceeding in th e same directi o n shall pass at a safe di sta nce to the left thereof, a nd whe n 24 ~5.061 safely clear of such overtaken vehicle shall take up a position as near the right-hand edge of the main-traveled portion of the highway as is practic able; .062 - Except when overtaking and pass in g on the right is permitted, the driver of an overtaken veh icle shall give way to the right in favor of the overtak ing vehicle on audible signal and shall not increase the speed of his veh icl e until completely passed by the overtaking veh icle . - The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following cond iti ons: . 07 .071 - When the vehicle overtaken is making or about to make a left turn; .072 - Upon a street or highway with unobstructed pavement not occupied by parked veh icl es of sufficient width for two or more lin es of moving vehicles in each direction and when such vehicles are moving in substantially con tinuous lanes of traffic; .073 - Upon a one-way street, or upon any roadway on which traffic is re str icted to one direction of movement, where the roadway is free from obstructions and of sufficient width for two or more lines of moving ve hicles and when such vehicles are moving in substantially continuous lanes of traffic; .074 - The driver of a veh icl e may overtake and pass another vehicle upon the right only under cond iti ons permitting such movement in safety. In no event sha ll such movement be made by driving off the pavement or main traveled portion of the roadway . . 08 . 09 . 10 . 11 . 12 . 13 . 14 It shall be unlawful to overtake or pass any veh icl e in a designated "no - No vehicle shall be driven to the left side of the center of a two-lane (or any multiple thereof) highway or in the center lane of a three- or five-lane lane highway in overtaking and passing another vehicle proceed in g in the same direction unless such left side or center lane is clearly visible and is free of on-com in g traffic for a sufficie nt distance ahead to permit such over taking and passing to be completely made without interfering with the safe operation of any vehicle approach ing from the opposite direction or any vehicle overtaken. The foregoing lim itation shall not apply upon a one-way roadway . - passing" zone . - Driving on three-lane roadway: Upon a roadway which is divided into three lanes a vehicle sha ll not be driven to the left of the center lane except when making a left turn and shall not be driven in the center lane except when overtaking and passing another ve hicle where the roadway is clearly visibl e and such center lane is clear of traffic within a safe distance, or in preparation of a left turn o r where such center lan e is at the time allocated exclusively to traffic moving in the direction the vehicle is proceeding and is signposted to give notice of such allocation . - Drivin g on one-way streets, alleys and rotary traffic isl a nds: Vehicu lar traffic shall move on ly in the indicated direction upon those streets and parts of streets and in those a ll eys a nd in those roadways around rotary traffic islands where signs have been erected indicating traffic shall move in only one direction. A vehicle passing around a rotary traffic island shall be driven only to the right of such isla nd . - No person shall drive any motor vehicle upon other than established roadway or parking area . - No person shall operate any bicycle upon other than established road ways, parking areas or bicycle paths . - No person shall r ide a ny an im al upon other than an es tablished road way, parking area or bridle path. 25 I 35.15 .15 - The provisio ns of 35 .1 2, 35 .1 3 a nd 35 .1 4 sha ll not apply whe n a publi c safety officer shall direct otherwise. 36.00- Turning Movements .01 . 02 . 03 - Signals for turning: T he driver of any vehicle upon a street before start ing, stopping or turning· from a direct lin e shall first see th at such move ment can be mad e in safety and sha ll give a signal as required in this section . - Signals for turning: Th e signal herein required sha ll be given either by means of th e ha nd and a rm in the manner here in specifi ed or by a mechan ical or electrica l sign a l d e vice wh ich conveys a n intelligible signa l or warn ing to anothe r drive r a pproaching from the rea r. Whenever the signal is given by means of th e hand and arm, the drive r sha ll indi cate his intention to turn by ex te nding the hand and arm hori zo nta ll y from and beyo nd th e left sid e of th e ve hicl e . - intersection, a ll ey or driveway shall do so as follows: Position for turning: The driver of a ve hicl e inte nding to turn at a n .031 - Both the approach for a right turn and a right turn shall be made as close as practica ble to th e right-hand curb or edge of th e roadway; .032 :_ . Approach for a left turn shall be mad e in that portion of the right half of th e roadway nea res t th e center line thereof a nd after enterin g an inter sectio,i th e le ft turn sha ll be made so as to leave the intersection to the ri ght of the center lin e o f th e roadway b~ing entered; .033 - Approach for a le ft turn t'r9m 4 two-way st ree t into. a 011e -wa y street shall be mad e in th at portion o f tl1e r.ig ~t ha lf of th e roadway" nearest th e cente r lin e th e reo f a nd by passing to th e right of such ce nte r line where it e nters the intersection. A left turn from a one-way street in to a two-way street shall be made fro m as close as practicabl e to the left-h a nd _curb or edge of the roadwa y and by passing to the ri ght o f th e ce nter line o f th e street being entered · upon leav in g the intersection . . 04 . 034 - Where both streets or roadways are one-way, both th e approach for a left turn and a le ft turn shall be made as close as practicable to the left hand curb or edge of th e roadway . - Signs limitin g turn: Wh e n pavement markers, signs or signals placed within or adjacent to intersections requ ire and direct that a different course from th at specifi ed in this article be traveled by vehicles turning at an in tersection, no driver of a veh icl e shall turn a vehicl e at such an intersection other than as directed by such marke rs , signs, or signals; and then onl y when such move ment ca n be made in safety and without inte rfering with other traffic. 37.00-Speed Regulations .01 . 02 - No person sha ll drive a vehicle on a highway at a speed greater than is reason able a nd prndent und e r the conditions then existing . - Where no special hazard exists, the following speeds sha ll be prima faci e lawful, but any speed in excess of said limits sha ll be prima faci e evidence that the speed is not reaso nable or prudent and is unlawful: .021 .022 .023 25 miles per hour in a n y school district; 15 mil es per hour in any reside ntial district; Any other numbe r of miles per hour when and as pos ted. 26 37.03 .03 . 04 The fact that the speed of a ve hicle is lower than the forego in g prima facie limits sha ll not relieve the driver from the dut)' to decrease speed when approachin g and cross in g an intersection, when a pproaching and go in g aro und a curve , when ap p roac hing a hill crest, when traveling upon any narrow or windin g roadway, or when spec ial hazards exist with respect to pedestrians or other traffic or by reason of weather o r highway cond i tions , and speed shall be decreased as may be necessary to avo id colliding with a ny person , vehicle or other conveyance on or enterin g the hi g hwa)' in compliance with lega l requ ire ments and the duty of a ll persons to use due care . - In e ver)' ch arge of violatio n of the provision of this section, by driving a vehicle in excess of the app licab le speed limits specifi ed un de r subsectio n .02 of this section , the co mpl aint, a nd also the summ ons or notice LO appear, shall specify the speed appli cab le within the district or at the location, a nd in the eve nt charges sha ll also be made o f violatio n of any other provisions of th is act, the co mpla int an d th e summons or notice to appear sha ll also spec ify such other offe nse alleged to ha ve bee n co mmitt.ed. 38.00- School Bus - Overtaking, Meeting, and Passing Stopped Bus, Signs on Bus .01 . 02 . 03 .04 - The drive r of a vehicle shall not overtake or meet a nd pass a n y school bus which has stopped for the purpose of rece iving or di sc hargin g passe n g·ers. A ll schoo l buses sha ll contain such signs on the back a nd from thereof, with respect thereto, as sha ll be approved by the State Hi g hway Co mmis s10ner . - The driver of a ve hicle overtak in g or meeting any school bus which has stopped for th e purpose of receiving or di sc hargin g any passenger shall bring such vehicle to a full stop at least 10 feet fro m the sc hoo l bus and sha ll not proceed until the sc hool bus r esumes motion or the sc hool bus drive r signals to proceed or the visual signa ls are no lon ge r actuated. Th e driver of th e school bus, before res uming motio n, shall signa l stopped traffic to proceed and sha ll when res uming motion proceed in such a m an ne r as to allow congested traffic to disperse by keepi ng the bus as nea r to the right side of the road as can be clone with safet)'. Passengers crossing the road upon being discharged from a school bus sh all cross in front of the stopped school bus. At a n intersectio n where traffic is co ntro lled by an officer or a traffic stop and go signal, a vehicle need not be brought to a full sto p before p ass in g a ny such school bus, but may proceed to p ass such school bus at a speed not greater th an is reasonable an d proper a nd in no event greater th a n 10 miles a n ho ur and with clu e ca ution for the safety of the passengers bein g received o r discharged from such sc hoo l bus . - No schoo l bus driver shall stop his bus upon the hi ghway for the purpose o f receiving or discharging passe n gers unless such bus is clear!)' visibl e in a stopped position to a pproac hing or overtak in g drivers of ve hicl es for a distan ce of at least 500 feet. - T he driver of a ve hicle upon a n y highway whi ch has bee n d ivid ed into two roadways by leav in g an inte rve nin g space, or by a physical ba rrie r , or clear!)' indicated dividin g sections so co nstru cted as to impede ve hicular tra ffic, need not stop upo n meetin g a school bus which has stop ped o n the roadway across the di vidin g space, barri er , or section. 27 >, I 38.05 .05 Eve ry sc hooCbus sha ll, in ad dition to any other eq uipm ent a nd distinc- tive markings required by law , be eq uipped with signal la mps mounted as high and widely spaced latera ll y as practicable whi ch shall be capabl e or displayi ng to the front two a lte rna tely flashing red li g hts a t th e same leve l and to th e rear two a lte rna te ly flashin g red lights loca ted at the same level. The red li ghts sha ll be no less than 6 inches in diameter and sha ll have sufficient intensity to be visible from a dista nce of at leas t 500 feel in norm a l sunlight a nd shall be actuated by the driver of the sa id school bus wh e never but o nl y when ever sa id ve hicle is stopped or is abo ut to stop for th e purpose of receiving or discharging sc hoo l childre n. 39.00-Parking .01 . 02 .03 . 04 . 05 . 06 . 07 - Except as otherwise provided in this section, ever y vehicl e stopped or parked upon a highwa y shall be so stopped or parked with the wheels of such ve hicle pa ra ll e l to the roadway an d within 12 inches of an y ex istin g right-h and curb . - Obedience LO a ngle-parkin g signs or markings: Upo n those streets o r in th ose parking lots which have been signed or marked by the Tra ffic En gineer o r Director of Public Safety for a ng le parking, no pe rso n shall stop, stand o r park a ve hicle other than al th e a ngle to the curb or e dge of the roadway indicated by such sig ns or ma rkings, and no perso n shall stop, stand o r park a vehicle except completely within such pave me nt markings as may ex ist. - Una u end ed moto r ve hicl e: No person havin g co ntrol or charge of a motor ve hicl e shall allow such vehicle to sta nd o n a n y highway or in any parkin g lot un a u e nd ed without first effecti vely selling th e brakes thereon and stop ping th e motor of said ve hicl e a nd when standing upon a ny grad e withou t turning the front wheels of such ve hicle to th e curb or sid e of hi g h way; nor sha ll a ny perso n leave any motor ve hicle unattended upon a ny street or in an y parking lot without re moving the keys from th e ignition o f' said ve hicle . - Parking not to obstru ct tra ffic: No p erso n shall park an y vehicle upon a street or in any pa rking lot in such a ma nner or unde r such co nditions as to leave availabl e insuffi cie nt width of the roadway for free move ment of vehicle traffic or so as to require veh icl es operating upon th e roadway to leave their assigned traffi c Ja ne in order to pass such parked ve hicl e . - A vehicle starting from a parked position shall give moving vehicles t he right-o f-way and th e operator o f such vehicle shall give a tim e ly a nd visibl e warnin g signal befo re so sta rlin g . - A ve hicle parked at an angle to th e curb and abo ut to start shall give moving vehicles the right-of-w ay and th e operator th e reof shall not back such veh icle from the curb into th e m ov ing la n e of traffi c unl ess such man e uver can be m ad e in sa fe ty and with o ut conflict with movin g vehicles, a nd shall not back such vehicle to cause oth er traffi c to yield right-of-way to avoid a collision . - Whenever a ve hicle is parked upon a street or highway durin g the hours betwee n one-ha lf' ho ur after sunset a nd o ne- half hour before sunrise, and at any other tim e when th e1·e is not suffi cient li ght to re nd e r clearly dis cernible persons a nd vehicles o n the highway at a distance of 500 feet ahead, there shall be disp layed upo n the left side of such vehicle .one or more lamps which shall exhibit a white light o n th e roadway side visible fro m a distan ce 28 39.07 . 08 . 09 of 500 feet to th e front of the vehicl e and a red ligh t visible from a distance of 500 feet to the rear . - Any lighted headlights upon a parked vehicle shall be depressed or dimmed . - Prohibitions (no signs required): No person sha ll stop or park a veh icle, exce pt when necessary to avoid conflict with other traffic or in compliance with law or the directions of a public safety officer or traffic-control device, in any of the following places : .091 .092 .093 .094 .095 .096 Within 20 feet of a crosswalk, or if non e, then within 15 feet of the inter On a sidewalk; In front of a public or private driveway; Within an intersection; Within 15 feet of a fire hydrant; On a crosswalk; section of property lines at an intersection of highways; .097 - Within 30 feet upon the approach to any flashing beacon, stop sign, yield right-of-way sign or traffic-control signal located at the side of the highway or roadway; .098 - Between a safety zone and the adjacent curb or within 30 feet of poims on the curb immediately opposite the e nds of a safety zone, unless a dif ferent length is indicated by signs or markings; .099 - With in 50 feet of the neares t rail of a railroad crossing; .0910- Withi n 20 feet of the driveway entrance to a ny fire station and on the side of a street. opposite th e e ntrance to any fire station within 75 feet of said entrance when properly signposted; .0911- Alongside or opposite any street excavatio n or obstruction when such stopping, standing, or parking would obstruct traffic; .0912- On the highway side of any vehicle stopped or parked at the edge or curb of a street; .0913- Upo n any br idge or other elevated structure upon a highway or within a highway tunn e l; .0914- Within 200 feet of an accident at which public safety officers are in at tendance; .0915- In front of any theater; .0916- In any place or in any manner so as to block immediate egress from any emergency exit or exits conspicuously marked as such on buildings; .0917 - . 10 . 11 .12 . 13 In a ny p lace or in any manner so as to block or hamper the immediate egress from any fire escape conspicuously marked as such providing an emergency means of egress from any building . - Motor buses, for the purpose of tak in g on or discharging passengers, may be stopped at the places designated in Sections 39.092, 39.094 and 39.096 of this ordinance, or on the highway side of a vehicle illegally parked in a lega ll y designated bus loading zone . - No person shall move a vehicle not law fully under his control into any suc h prohibited area or away from a curb such distance as is unlawful. - No person shall drive a motor vehicle or park such vehicle upon the grass or over a curb or beyond the designated highwa y width or off the shoulder of a highwa y unless otherwise directed to do so by a public safety officer . - Proh ibiti ons and res trictions (signs requ ired): No person shall stop, stand, or park a vehicle, exce pt when necessary to avoid conflict with traffic or in compliance with law or the direction of a public safety officer, in vio lation of any legally established parking restriction or prohibition, pro vided that signs stating such restrictions or prohibitions are duly posted in accordance with this ordinance. 29 39.14 of: .14 .141 .142 No person sha ll park a veh icl e upon any street fo r the principal p urpose Disp lay in g such vehicle for sa le; .223 - T he driver of a ve hicle may sto p temporari ly at a p lace mar ked as a 30 39,223 . 23 . 24 . 25 . 26 . 27 freight loading zone for the purpose of and while actually engaged in load ing or unloading passengers, when such stopping does not interfere with any motor vehicle used for the transportation of materials which is waiting to enter or about to enter such zone . - Stopping, standing or parking of buses and taxicabs regulated: The operator of a bus or 1axicab shall not stop, stand or park upon any street in any business district at any place other than at a bus stop or taxicab stand, respectively, except that this provision shall not prevent the operator of any such vehicle from temporarily stopping in accordance with other stop ping, standing or parking regulations al any place for the purpose of and while engaged in the expeditious unloading or loading of passengers . - Restricted use of bus and taxicab stands : No person shall stop, stand or park a vehicle other than a bus in a bus stop or other than a taxicab in a taxicab stand when such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may tem porarily stop therein for the purpose of and while actually engaged in the expeditious loading or unloading of passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone . - In any proceeding for violation of the parking provisions of this or dinance, the registration plate and/or university permit displayed on such motor vehicle shall constitute in evidence a prima facie presumption that the owner of such motor vehicle was the person who parked or p laced such motor vehicle al the point where such violation occurred . - No parking tow-away zone: The Traffic Engineer or Director of Public Safety may establish temporary or permanent "No Parking" zones in which , by posting of "Tow-away Zone" signs, vehicles parked in violation may be towed away and impounded . - No person shall open the door of a motor vehicle on the side adjacent to moving traffic unless and until it is reasonably safe to do so, nor shall any person leave a door open on the side of a motor vehicle next to moving traffic for a period of time longer than necessary to load or unload passen gers. 40.00- Miscellaneous Rules .01 - Driver's license: No person shall drive any motor vehicle upon a street within the boundaries of Michigan State University unless such person is licensed as an operator or chauffeur as required by Michigan Vehicle Code, Act 300, Public Acts of 1949, as amended . . 011 - Every operator of a motor vehicle shall at all times have in his immedi ate possession when driving a motor vehicle his operator's or chauffeur's license. The certificate of registration shall at all times be carried in the ve hicle to which it 1-efers or shall be carried by the person driving or in con trol of such vehicle. The license or certificate shall be submitted for ex amination upon demand by any public safety officer; .012 - lt shall be unlawful for any person to display or cause or permit to be displayed or to have in possession any operator's or chauffeur's license knowing the same to be fictitious, or to have been canceled, revoked, sus pended, or altered; to lend or to knowingly permit use of, by one not en titled thereto, any operator's or chauffeur's license issued to the person so lending or permitting the use thereof; to display or to represent as one's own any operator's or chauffeur's license not issued to the person so dis playing the same; 31 40.013 .013" - It shall be unlawful for an operator holding an instruction permit to operate a motor vehicle unless accompanied by a licensed operator or chauf feur who is actually occupying a seat beside the driver; .014 - It shall be unlawful for the owner of a motor vehicle to knowingly . 02 . 03 . 04 . 05 . 06 .07 . 08 . 09 .10 . 11 . 12 authorize or permit any unlicensed driver to drive such vehicle . - License plates, No person shall operate a motor vehicle on the streets within the boundaries of Michigan State University without having his motor vehicle equipped with license plates as provided in the Michigan Vehicle Code, Act 300, Public Acts of 1949, as amended . - Reckless driving, Any person who drives any vehicle upon a street, side walk, parking area or structure, recreation , lawn or farm area or within any building carelessly and needlessly in willful or wanton disregard of the rights or safety of others, or without due caution and circumspection and at a speed or in a manner so as to endanger or be likely to endanger any per son or property, shall be guilty of reckless driving . - Drivers to exercise due care: Every driver of a vehicle sh a ll exercise due care to avoid colliding with any pedestrian , vehicle or other object upon an y roadway, area adjacent to any roadway or area open to motor vehicles and shall give warning by sounding the horn when necessary . - It shall be unlawful for any person , whether licensed or not, who is an habitual user of narcotic drugs, barbital or any derivative of barbital, or any person who is under the influence of intoxicating liquor or narcotic drugs, barbital or any derivative of barbital, to drive any vehicle upon any street or any other place within the boundaries of Michigan State University . - It shall also be unlawful for the owner of any motor vehicle or any per son having such in charge or in control thereof to authorize or knowingly permit the same to be driven or operated upon any street or any other place within the boundaries of Michigan State University by any person who is an habitual user of narcotic drugs, barbital or any derivative of bar bital or any person who is under the influence of intoxicating liquor or narcotic drugs, barbital or any derivative of barbital. - Driver regulations applicable: Every person operating a motorcycle or motor-driven cycle upon a roadway shall be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle under this ordinance except as to those provisions which by their nature can have no application . - The operators of motorcycles or motor-driven cycles shall not ride more than two abreast on any roadway and shall comply with the seating and con trol requirements prescribed for bicyclists in Sections 43.07 and 43 .08 . - Spotlights: A motorcycle shall not be equipped with more than one spot lamp, and every lighted spot lamp shall be so aimed and used upon approaching another vehicle that no part of the beam will be directed into the eyes of the approaching driver. Spotlights may not emit other than either a white or amber light. - Every person riding animals or driving any animal drawing a vehicle upon a street shall be subject to the provisions of this ordinance applicable to the driver of a vehicle, except those provisions of this ordinance which by their nature can have no application . - Persons riding or leading animals on or along any street shall ride or lead such animals on the left side of said street facing approaching traffic . - No person shall use the streets for traveling on skis, toboggans, coasting sleds or similar devices. No person shall use any roadway within the boun daries of Michigan State University as a sled or ski course for the purpose of coasting on sleds, skis, or other similar devices except on portions of 32 40.12 . 13 . 14 such streets officiall y set aside for such use and adequately roped off or otherwise marked for such purpose . - Driving through funeral or other procession: No ope1·ator of a vehicle shall drive through the vehicles, persons, or an imals comprising a funeral or other authorized procession while such funeral or procession is in motion except when otherwise directed by a public safety officer. This provision shall not apply to authorized emergency vehicles . - Permits required for parades, processions, and sound trucks: No funeral, procession, or parade, excepting the forces of the United States Armed Services, the military forces of this State, and the forces of the police and fire departments sha ll occupy, march or proceed along any street or road way except in accordance with a permit and such other regulations as are set forth herein which may apply. No sound truck or other veh icle equipped with amplifier or loudspeake1· may be used unless written authorization is obtained as indicated in Section 2 .03 . - Backing: The driver of a vehicle shall not back said vehicle: . 15 .151 - Un less such movement can be made with safety and without interfering with other traffic; .152 - Under such circumstances as to cause other traffic to yield right-of-way to avoid a collision; .153 - Through or into any inter·section of two or more roadways . . 16 - Vehicles shall not be driven on a sidewalk or footbridge. The driver ofa vehicle shall not drive upon or within any sidewalk area or footbridge except at a driveway . - Driving through safety zones prohibited: No veh icle shall at any time be driven through or within an occupied safety zone . - Splashin g: No person sha ll recklessly , wilfully , wanton ly or carelessly operate his vehicle in such manner as to sp lash snow, rain , water, mud, din, or debris on any person then upon a sidewa lk or crosswa lk . - Leaking or spilling: No vehicle sha ll be driven or moved on any stree t unless such vehicle is so co nstructed or loaded as to prevent its contents from dropping, sifting, leaking, or otherwise escaping therefrom . - Crossing fire hose: No vehicle sha ll be driven over any unprotected hose of a fire department without: the consent of the fire department official in command . - Coaster, roller skates and similar devices restricted: No person upon roller skates, or riding in or by means of any coas ter , toy vehicle or sim il ar device, shall go upon any roadway except while crossing a street on a cross walk, and when so crossing such person shall be granted all of the rights and shall be subject to all of the duties appl icabl e to pedestrians. Th is sec tion shall not apply upon any street whi le set aside as a play street as pro vided for in this ordinance . - Clinging to vehicles: No person riding upon any bicycle, motorcycle, motor-driven cycle, coaster, sled, roller skates or any toy vehicl e sha ll at tach the same or himself to any vehicle upon any street. - Boarding or alightin g from vehicles: No person shall board or alight from any vehicle while such vehicle is in motion . - Restrictions on trucks and commercial vehicles upon use of streets: When signs a1·e erected giving notice thereof, no person shall operate or stop, stand or park any truck or commercial vehicle with a gross weight in excess o f the amounts specified th ereon at any time upon any of the streets or parts of streets on which such signs have been posted . - Lamp or flag on projecting load: Whenever the load upon any vehicle extends to the rear 4 feet or more beyond the bed or body of such vehicle, th ere sha ll be displayed at th e ex treme rear end of the load, during the . 17 . 18 . 19 . 20 . 21 . 22 .23 . 24 . 25 33 40.25 hours between one-half hour after sunset and one-half hour before sunrise, and at any other Lime when there is 1101 suflicient li g-ht to re nd e r cl early discernible persons and vehicles on the highway at a distance of 500 feel ahead, a red light or lante rn plainly visible from a distance of al least 500 feet to the sides and rear. The red light or lantern required under this sec tion shall be in addition to the red rear light required upon every vehicle. At any other time there shall be displayed al the extreme rear end of such load a red flag or cloth not less than 12 inches square and so hung that the entire area is visible to the driver of a vehicle approaching from the rear. - No person shall drive a vehicle when it is so loaded, or when there are in the front seal such number of persons as to obstruct th e view of the driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle . - No passenger in a vehicle shall ride in such position as LO interfere with the driver's view ahead or LO the sides, or to interfere with his control over the driving mechanism of the vehicle . - No person in a bus, trolley coach, or other transit vehicle sha ll stand beyond the safety line which shall be inlaid, constructed in the floor or painted upon th e floor so as to interfere with or obstruct the driver's view to the front or sides, or to obstruct the view of signa ls he may give to drivers of other vehicles . - No person sha ll drive any motor vehicle with a window so damaged or with any sign, poster or other non-transparent material upon the front windshield , sidew ings, side or rear windows of such vehicle so as lo obstruct the driver's view, other than a certificate or other paper required to be so displayed by law . - No vehicle shall be operated upon any street unless the driver's vision through any required equipment is normal and unless such vehicle complies with the provisions of Section 41.00 . - No owner shall display upon any part of his vehicle or knowingly per mit the display thereon of any official designation, sign, or insign ia of any public or quasi-public corporation, municipal, state or nationa l department or government subdivision without authority of such age ncy . - Any person who drives any vehicle upon a street, sidewalk, parking a rea or structure, recrea tion area, lawn or farm area or within any building carelessly and heedlessly , but without wantonness or recklessness , in a manner so as to endanger or be likely to endanger any pe rson or property shall be guilty of driving in an unsafe manner. .26 . 27 . 28 . 29 . 30 . 31 . 32 41.00- Equipment .01 . 02 . 03 34 - No person shall drive or move and no owner shall cause or knowingly permit to be driven or moved on any street or any other place upon prop erty governed by the Board any vehicle or combination of vehicles which is in such unsafe condition as to endanger any person or which does not contain those parts or is not at all times equipped with such lamps and othe r equipment in proper condition and adjustment as required by this section, or which is equipped in any manner in violation of this section . - Every molOr vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive noise and annoying smoke, and no person shall operate on the streets a motor ve hicle equipped with a muffler cut-out, by-pass or simi lar device , or a device for the purpose of causing fl a me or smoke to be emitted from a vehicle, except a highway maintenan ce vehicle . - The engine and power mechanism of every motor vehicle shall be so eq uipped and adjusted as to prevent the escape of excessive fumes or smoke. 4L04 .04 . 05 . 06 .07 . 08 . 09 .10 . 11 No perso n shall introduce a ny gaso li ne, foreign material or o bstru ction into th e muffler o r ex ha ust pipe wh ich ca uses or is capable of causin g ex haust gases to igni te, burn , or fl as h in any manner or form . - Lights: Ever y vehicle upon a street within th e boundaries of Michigan State Uni versity shall be equ ipped with li ghts which shall be lighted in ac cord ance with th e prov isions of th e Michi gan Veh icl e Code, Act 300, Public Acts of Michigan , 1949, as a mended . - Spot lamps : Any motor ve hicl e may be equipped with not to exceed two spot la mps, and every lighted spot lamp sha ll be so aim ed a nd used upon approach in g another vehicle that no part of the beam wi ll be directed into the eyes of the a pproaching driver. Spot lamps may not e mit other than e ith e r a white or amber light. - Flashing, RED and GREEN li ghts: No ve hicl es except those a uthori zed by law shall display any flashing ligh t except directiona l signals, or a reel light lo the front or a gTeen light to the rea r . - Bra kes : Ever y motor ve hicl e or combination of motor-drawn vehicles when o perated u pon a street or any other p lace with in th e boundaries of Mi chigan State U ni versity sha ll be equipped with brak es of such construc tion and capable at all times and under all condi tio ns of stopping th e ve hicl e in such mann er as r equired by the Mi chiga n Vehicle Code, Act 300, Public Acts of Michigan, 1949, as amended . - Horns : Every motor vehicle wh e n being operated sha ll be equipped with a horn in good working order and capable of emitting sound audible under normal cond iti ons from a distance of not less than 200 feet, but no horn or other warning d evice shall e mit an unreasonable loud or harsh sound or a whistle. The driver of a motor vehicle shall , when reaso nab ly necessa r y to insure safe operation, give a udibl e warning with his horn but shall not otherwise use such horn when upon a street. - Obstruction to view : No pe rson sha ll dri ve any motor vehicle with any sign , poster or other non-transparent m aterial upon the front windshi e ld, siclew i ngs or side of rear windows of such vehicle which obstructs the drive r's cl ear view o f the highway or other suspe nd ed object as authorized by law, which in any way obstructs the vision of the driver of the vehicle . - Windshield wip e r: T he winds hi e ld of every motor ve hicl e sha ll be equipped with a device for cleaning rain , snow or other moisture from th e windshield , which d ev ice shall be so constructed as to be contro ll ed by the driver of th e vehicle and shall be continuous ly se lf-operating after having bee n actuated by the driver of the vehicl e . . 111 - Every windshield wiper upon a moto r ve hicl e sha ll be maintained in . 12 . 13 good working order . - Windshield washer: No motor vehicle li censed as such an manufac tured after January 1, 1956, shall be operated on the streets or property of Mich iga n State University unless it is equipped with a windshi eld washer maintained in ope rable cond ition at all times and capab le of clea ning th e wind sh ield in such a fash ion as to leave the driver with a cl ear view of th e highway or any intersecting highway . - Tires: No motor truck , tractor, trailer or semi-trailer sha ll be o perated o n the pave d areas of the property governed by th e Board if th e tires are equ ipped with metal that comes in contact with the surface of th e road or wh ich have a partial contact of metal with the surface of the road . . 131 - No tire on a vehicle moved on any paved a rea shall have on its periphery an y block, stud, flange, cleat, or spik e or a ny othe r protubera nce of any material oth er than rubber which projects beyond the thread of the trac tion surface of the tire, except that it sha ll be permissib le to use farm ma- 35 41.13 . 14 . 15 chi nery with tires havin g protuberances which will not injure Lh e highwa y, a nd except also that it sha ll be permiss ibl e to use tire chai ns of reasonab le proportions upon an y ve hicl e when required for safety beca use of snow, ice, or other co nditions tending Lo cause a vehicle to skid . - View to rear, mirrors: No person sha ll drive a motor vehicle o n a street o r parkin g a rea or strucLure when said moLOr ve hicl e is so co nstru cted o r loaded as to prevent Lhe dri ver from obta inin g a view o f th e street to the rear by loo king backward from Lh e drive r's pos itio n unl ess suc h vehicle is eq uipped wiLh a mirror so located as to re Aec t to the d rive r a view of th e street LO the rea r of th e sa id ve hicle. Every co mm e rcial ve hicl e of o ne-half ton ca pacity or mo re, operatin g upon th e street, sha ll be equipped with two mirro rs, o ne on each sid e, so adjusted th at the ope rator shall have a clear view of th e street beh ind such commercial ve hicle . - Si ze, weight, and load: No person shall dr ive or move or ca use or know ingly permit to be drive n or moved o n a n y street an y ve hicl e o r ve hicl es of width, heig ht, le ngth or weig ht in excess of th e limi tatio ns g·ove rnin g size and we ight restrictions specifi ed in the Mi ch igan Ve hicle Code, Act 300, Public Acts of Michi ga n , 1949, as amended. 42.00- Traffic - Pedestrians .01 . 02 . 03 . 04 . 05 . 06 . 07 . 08 . 09 - Pedestria ns sh a ll be subject to tra ffic-control sig nal s at inte rsec tio ns as provided for in Sections 34.012, 34.0 14, 34.0 16, 34.019 and 34. 03 of thi s ordin ance , and a t a ll oth e r places pedes trians shall be acco rd ed th e priv il eges and shall be subj ect to the restriction s stated in this sectio n . - Ped estr ia n's right-of-wa y a l crosswalks: Wh e re tra ffi c-contro l signals are not in pl ace or in o peration , the drive r of a ve hicle shall yie ld the right-of way to a ped es trian cross ing th e roadway within a ny mark ed crosswa lk or within any unmarked crosswa lk a t a n inte rsecti on, except as oth erwise pro vided in thi s section . - When e ver specia l ped es tri a n-control s igna ls ex hibitin g the words "Walk," "Don 't Wa lk" or "Wait" are in p lace, such signa ls sha ll indica te as specifi ed in Section 34.03 . - Between adj ace nt in te rsec tions at whi ch traffic-control sign als are in operation pedestri a ns sha ll not cross th e roadway except in a marked cross wa lk . - A ped estrian sha ll yie ld th e ri g ht-of-way to an e mergency vehicle unde r th e condi tions prescribed in Section 47 .04 . - No ped estrian sha ll pass through , around , over o r und er a n y crossing ga te or barrier at a rai lroad grade cross in g o r bridge whil e such gate o r ba rrie r is closed or is being o pe ned or closed . - Ped es tri a ns to use ri g ht ha lf of crosswalk: Pedestrians sha ll move, when ever practicable , upon th e right ha lf of crosswa lk . - Cross in g r oa d way at right a ngles: No p e d es trian sha ll , exce pt in a marked crosswa lk, cross a roadway at a n y other place th a n by a route at right a ngles to the curb or by the shortest route to the opposite curb . - Crossin g at other th an crosswa lks: Every ped estri a n cross in g a road way at an y po in t othe r than within a marked crosswa lk or within a n unmarked crosswa lk at an intersection sha ll yie ld th e ri ght-of-way to all ve hicl es upon th e roadway . . 091 - Any pedes tri a n cross in g a roadway at a point where a pedestr ia n tunne l or overh ead pedestrian crossing has been provided shall yie ld th e ri g ht-of wa y to a ll ve hicles upo n th e roadway . - Walk o n left side of roadway: Where si d ewalks are prov id ed , it sh all be unl aw ful for p ed estri a ns to walk upon th e main trave led portion of the . 10 36 42.10 .11 . 12 . 13 street or roadway. Where sidewa lk s are not provided, pedestrians sha ll , when practicable, wa lk on the left side of the street or highway facing traffic which passes nearest. - Pedestrians soliciting rides or bus iness: No person sha ll stand in a road way for th e purpose of so li citing a ride, employment or business from the occupant of any vehicle . - White canes : Any driver of a vehicle who approaches within IO feet of a person wholl y or partially blind, carryi ng a cane or walking stick which is white or white tipped with red, or being led by a guide dog wearing a harness and walking on either side of or sli ghtly in front of sa id blind per son, shall immed iately come to a full stop and take such precautions before proceedii1g as may be necessary to avoid accident or inju ry to the person wholly or partially blind . - When traffic con trol signa ls are not in place o r not in opera tion th e driver of a ve hicl e sha ll yie ld the right of way, slowin g d ow n o r stopp ing if need be to so yie ld , to a pedestrian crossi n g th e roadway within a cross walk when th e pedestrian is upon the half o f the roadway upon which the vehicle is tra ve lin g, or when the pedestrian is approach ing so closely from th e opposite half of the roadway as to be in danger, but no pedestri an shall suddenly leave a cur b o r other place of safety and walk o r run into the p ath of a vehicle, which is so close that it is imposs ibl e for the dri ver to yield. 43.00- Bicyclists - Traffic .01 . 02 . 03 . 04 - The term "bicycle" as used in this ordinance shall mean a nd includ e any one or two-wheeled device hav in g a wheel or wheels 16 inches o r greater in diameter which is propelled by huma n power. T he term "bicycle" as used in this ordinance shall not be deemed to includ e vehicles propelled by a motor or engine of any kind . - It shall be unl aw ful for any person to operate o r leave unattended upo n th e ca mpus any bicycle which does not bear a cu rrent a nd va lid li ce nse or pe rmit issued by th e Michigan State University Department of Public Safety, the City of Lans ing, or the C ity of East La nsin g . - The permission to operate a bicycle in and upo n th e campu s sha ll be evid enced by a permit tag to be designed by the Michigan State U nive rsity Department of Publi c Safety. Such permit tag is to be made of metal or other durable co mpositio n a nd shall be issued by the Michigan State Uni versity Departm e nt o f Public Safety after acce ptance for filing of the appli cation for a permit. Each ow ner or ow ners of a bicycle sha ll, upon receiving a pe rmit tag from the Department o f Public Safety, ca use the sa me to be affixed in a conspicuous place on th e bi cycle covered by sa id permit, pro vided, however , that the Michigan State University De pa rtm ent of Public Safety may, in their discretion, designate the pa rticula r place o n eac h bi cycle where the permit tag sh all be displa yed by th e owner o r o wn e r s thereof. Such permit tags sh all be displayed on each bicycle at all times when the same are being operated in and upon the camp us . - Upon th e sale or other transfer of a licensed bicycle by the ow ner or owners thereof, said own e r or owne rs shall remove the per mit tag and shall surrender th e same to the Michigan State University Department of Public Safety : Provided , however, that said ow ner or owners, together with th e transferee or vendee of said bicycle, may apply to the Michigan State U ni versity Department of Public Safety for the tra nsfe r of the registrati on of 37 43.04 said bicycle and the permit to ope rate same to the vendee or transferee, and upon such application to the Michigan State University Department of Public Safety sh a ll th e n cause the registration of said bicycle and the per mit to operate the same to be placed in the name of the vendee or trans feree . - Application for a permit to operate a bicycle shal l be made upon bring ing a bicycle not meeting the requirements of Section 43.02 of this ordinance upon the campus. For the convenience of the public, the Department of Public Safety shall provide for bicycle registration at some time during every day of the year except Saturdays, Sundays and holidays . - The Department of Public Safe ty shall take into its custody and impound any bicycle found upon the campus which is not properly registered or licensed as provided in this ordinance, or which is parked in violation of sections 43.17, 43.18, 43 .1 9, 43.20, 43.21, 01· 43.22, and sha ll release such bicycle only after it shall be properly registered by its owner and a fee for its impoundment paid, or a summons issued to the owner for the alleged violation . The fee for impounclment shall be of such amount as shall reimburse the University for a ll costs of impounding and enforcing the provisions of this ordinance. Impounded bicycles not claimed shall be auctioned and the proceeds of such auction app li ed to the cost of enforce ment and impounclment. - unless the same shall be equipped as hereinafter set forth: It shall be unlawful for any person to operate a bicycle on the campus . 05 . 06 .07 .071 - Every bicycle which is operated during the period from one-half hour after sunset to one-ha lf hour before sunrise shall be equipped with an ac tivated white lamp on the front thereof, visible under normal atmospheric conditions from a distance of at least 300 feet in front of such bicycle, and sha ll a lso be equipped with a reflect mirror reflector or lamp on the rear, exhibitin g a reel light visible under like conditions from a distance of at least 200 feet to the rear of such bicycle; . 11 . 12 . 08 .09 . 10 .072 - Every bicycle shall be equipped with a suitable brake adequate to con trol the movement of and to stop said bicycle within a reasonable distance on a dry, smooth, hard-surfaced road . - No persons operating bicycles on the campus shall ride more than two abreast. - No person sha ll operate a bicycle at a speed faster than what is reason able and proper with regard to the safety of the operator and others . - No person operating a bicycle shall attach himself to any other moving vehicle . - Every person operating a bicycle shall accord the right-of-way to pedes trians crossing roads and streets on the campus at all intersections and crosswa lks . - T he operator of a bicycle shall at no time remove both feet from the pedals thereof nor both hands from the handlebars or steering apparatus of said bicycle, nor shal l any operator drive said bicycle in a careless or reckless manner or practice any acrobatic riding while said bicycle is being operated on the campus . - No operator of a bicycle shall cause the same to be driven upon or across any sidewa lk or footpath situated on the campus or upon the campus grounds: Provided, however, that the operator of any bicycle may dis mount from such bicycle and proceed upon such sidewalks and footpaths on foot, pushing said bicycle while so proceeding on foot. - Every person operating a bicycle on a roadway on the campus shall be granted all of the rights and shall be subject to all of the duties applicable to the driver of a motor vehicle by the laws of the State of Michigan except . 13 .14 38 \ 43,114 . 15 .16 . 17 . 18 . 19 . 20 . 21 . 22 . 23 insofar as the provisions of this ordinance for th e operati on of such bicycle shall conflict or modify said general laws which by their nature can have no application to the operation of bicycles . - Any person operating a bicycle upon a roadway on the campus shall obey the instructions of all official traffic-control signals, signs and other control devices applicable to motor vehicles unless otherwise directed by a public safety officer. - The Michigan State University Department of Public Safety shall as soon as may be practicable, lay out and establish upon the campus certain areas to be utilized as parking lots or areas for bicycles. The l'vlichigan State Un iversity Department of Public Safety, pursua111 to the au1hori1y hereby vested with them , shall establ ish a sullicie111 number or bin de parking lois to adequate ly accommodate the number or bin·des duly regis1cred and licensed und er the provisions of this ordinance, and said bicycle parking lots and areas sha ll be establi shed at div e rse appropriate places on the cam pus. In the establi shing of said bicycle parking lots and areas, the Michigan State University Department of Publi c Safety shall consult and advise with the President of Michigan State Un ivet·sity and the Landscape Architect of Michigan State University . - Upon th e establishment of bicycle parking lots and areas as herein pro vid ed for, it shall be unlawful fo r the operator of a bicycle to ca use the same to be parked in any place upon the campus outside of said bicycle parking lots and areas. In the event that bicycle parking racks are avai lable in said parking lots and areas , the operator of a bicycle sha ll park such bicycle in th e racks which may be provided. In the event th at there are no racks pro vid ed or that the numbe r of said racks is insuffici e nt Lo accommodate him , the operator or a bicycle sha ll park his bicycle in an upright position within the co nfines of said parking lots or areas . - No bicycle sha ll be parked in any space designed and imended for use by motor vehicl es unless such area shall be specifica lly allocated to bicycle parking by placemenL of a bicycle rack . - No bicycle in an inoperable condition, shall be parked on university property for a period longer than 48 hours. Any such inope rable bicycle shall be impounded by the Department of Public Safety and its ow ner shall pay the impoundment fee prescribed above to secure release of said bicycle . - No bicycle shall be parked and left unattended unless such bicycle is locked to a bi cycle rack or immobili zed with a locking device . - The Director of Public Safety is hereby authorized to publish special regulations providing for removal of bi cycles from a bicycle parking area or areas and prohibiting bicycle parking in such area or areas for designated periods for ground maintenance and improvements or other unive1·sity functions. Bicycles not removed from such areas or parked after the special regulations have been published shall be in violation of this ordinance and shall be impounded as provided for in Section 43.06 . - No person shall park any bicycle on the campus longer than 48 hours unless he is currently registered as a student, is employed by the university or is currently residing on university property. Bicycles parked contrary to this provision shall be in violation of this ordinance and shall be impounded as provided for in Section 43 .06 . - A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached to the bicycle. No bicycle shall be used to carry more persons at one time than the number for which it is designed and equipped. 39 44.00-Accidents - Traffic .01 . 02 . 03 . 04 . 05 . 06 . 07 - Duty to stop at scene of accident involving death or personal injuries or damage to vehicles: The driver of any vehicle directly involved in an ac cident resulting in injury to or death to any person, or resulting in damage to a vehicle which is driven or attended by any person shall immediately stop such vehicle at the scene of such accident or as close thereto as possible, but shall then forthwith return to and in every event remain at the scene of the accident until he has fulfilled the requirements of Sections 44.02, 44.03 or 44.04. Every such stop shall be made without obstructing traffic more than is necessary . - Duty to give information and render aid: The driver of any vehicle in volved in an accident resulting in injury to or death of any person or dam age to any vehicle which is driven or attended by any person shall give his name, address , and the registration number of the vehicle he is driving and shall upon request exhibit his operator's or chauffeur's license to the person struck or the driver, or occupant of or person attending any vehicle col lided with and where practical shall render to any person injured in such accident reasonable assistance, including the making of arrangements for the transporation of such person to a physician, surgeon or hospital for medical or surgica l treatment, if necessary, or if such transportation is requested by the injured person . - Duty to report accidents immediately: The driver of a vehicle involved in an accident resu lting in injury or death to any person or any property damage sha ll by the quickest means of communication give notice of such accident to the Department of Public Safety. No vehicle involved in such accident shall be moved except when so ordered by a public safety officer . - When driver un able to report: Whenever the driver of a vehicle is phys ically incapable of making a required accident report and there was another occupant in the vehicle at the time of the accident capable of mak ing a report, such occupant shall make or cause to be made said report . - Duty upon striking unattended vehicle, The driver of any vehicle which collides with any vehicle which is unattended sha ll immediate ly stop, and shall then and there either locate and notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle strik ing the unattended vehicle, or if such person cannot be located, shall leave securely attached in a conspicuous place in the vehicle struck a written notice giving the name and address of the driver and of the owner of the vehicle doing the striking and a statement of the circumstances thereof, and shall report such accident as provided in Sections 44.03 or 44.04 of this ord inance . - Duty upon striking fixtures on a street or roadway: The driver of any vehicle involved in an accident resulting on ly in damage to fixtures legally upon or adjacent to a street sha ll take reasonable steps to locate and notify the owner or person in charge of such property of such fact, and of his name and address and of the registration number of the vehicle he is driv ing, and shall upon request exhibit his operator's or chauffeur's license and shall make a report of such accident as provided in Section 44.03 of this ordinance . - Garages to report: The person in charge of any garage or repair shop to which is brought any motor vehicle which shows evidence of having been involved in an accident, or struck by any bullet, shall report to the Depart ment of Public Safety immediately after such vehicle is received and before any repairs are made to such vehicle, giving the engine number, registration number, and the name and address of the owner and operator of such ve hicle , together with any other discernible information. 40 ) \ .08 - Accident re po rts confidential: All accident re ports and supple me ntal re po rts required o f drivers of ve hicles by Sectio n 45 .4 7 shall be witho ut prejudice to the indi vidual re porting. a nd shall be fo r the co nfide nti al use o f the Departme nt of Public Sa fe ty a nd the Commiss ion er of State Police. exce pt that th e Depa rtme nt of Publi c Safety may di scl ose the ide ntity o f a pe rson involved in an accid e nt wh en such id e ntity is not oth e rwise known o r whe n su ch person de nies his prese nce at su ch acc ide nt.
