Section 1.00- Statement of Purpose .0 1 - It appearing to the Board of Trustees of Michi gan Sta te Un iversity th at regu la tio ns for the care, prese rva ti on and protection of the property gove rned by th e Board and for co ntrol of the cond uct of those on said p rop erty are essential to sec u re the successfu l ope ratio n of the Uni versity, maintain good order, pro mote the d es igned obj ectives of the University, a nd to obviate u n necessary and imprope r interferences with Uni versity activities and th e lawfu l activities o f th ose com in g u pon land governed by the Board , the Board hereby ado p ts the fo llowing provisio ns: 2.00- Effectiveness of Ordinance .01 . 02 . 03 . 04 - This ordina nce sha ll be effec tive at 12:01 a. m., Septe mber 15, 1964 . - All ordin ances p revio usly enacted by the Sta te Boa rd of Agricu lture are her eby d ecl ared null and void . - Any excepti ons to th e fo llowing sections of th is ord in ance must be made by written autho ri zation of the office of th e Secretary of the Board of T ru s tees fo r Michi ga n State University: 9.0 1, 12.0 1, 14.0 1, 20.01 , 23 .0 1, 26.0 1, 29. 01 , 30.0 1, 30.02, 3 1. 0 1, 3 1.03 , 39.1 44 an d 40. 14 . - T he p rovisio ns o f this ord ina nce shall not a p ply to the sa le or distri bu tion of student p ublicatio ns except that the meth od of distri bu tion sha ll no t interfer e with normal un ivers ity fun ctio ns. 3.00-Authority of Board of Trustees .01 - T hi s ord inance is enacted by the Board o f T rustees p urs uant to a nd in accordance with the autho ri ty and res ponsibili ty of sa id Board as ou tli ned in the Co nstitu tio n of the State of Michi ga n, Public Act 80 of 1905, as ame nded , and Public Act 269 of 1909, as amend ed . 13 4.00 4.00- Designation of Enforcement Powers .01 . 02 . 03 - Pursuant to the authority stated in Section 3.0 I, the Board of Trustees does hereby entrust the Director of the Department of Public Safety of Michigan State Un iversity with the duty of enforcing this ordinance . - The Director of the Department of Public Safety of Michigan State Uni versity is also charged with the responsibility to appoint subordinates who shall, among other things, be employed to enforce this ordinance . - When for the purpose of maintaining necessary control of property governed by the Board of Trustees located in areas beyond the property at or adjacent to East Lansing, and the conduct of persons coming onto this property, the Board may authorize the application of this ordinance or portions of this ord inance to said property. Enforcement authority may be vested with appropr iate loca l officials. · 5.00- Duties of Public Safety Officers - Every such person, duly appointed, shall apprehend and arrest any person in violation of any provision of this ordinance and shall make complaint against such violator before any judge having jurisdiction; shall restrict access to any area for the protection of an individual, crime scene, or public safety or convenience; is empowered to delegate to any citizen or peace officer any part or all of his authority to enforce any part or all of the provisions of this ordinance when the citizen or peace officer is acting in conjunction with the public safety officer; shall inspect the properties un der control of the Board and establish the identity of those persons found upon the premises after hours or in unusual circumstances; may eject from the property under control of the Board any person unable to establish his right upon the property; shall take into custody any property that appears to be lost, stolen or abandoned; shall cause to be towed and/or impounded any motor vehicle or bicycle parked con trary to the provisions of the ordinance when the vehicle is causing damage, is parked upon a lawn or crop area, is obstructing normal movement of the public or univer sity operations or is in violation of the provisions of this ordinance; shall take into protective custody any student appearing to be mentally disturb ed until such student can be placed into the care of University Health Center personnel for diagnosis and disposition; shall take into custody any animal found running loose upon property under control of the Board until the animal can be returned to its owner or placed in custody of an animal shelter; shall destroy any animal running loose upon property under control of the Board if unable to capture it; shall take care to ensure the safety and convenience of all persons coming onto property under control of the Board and shall arrest any person who, without proper authority, interferes with or obstructs the right of any person to move about the property in accordance with this ordinance and established rules and regulations; shall be diligent to secure respect for and protection of the civil rights of all persons; may eject from property under control of the Board any person not complying with established rules and regulations even if the rules and regulations are not enforceable under this ordinance; shall ensure by immediate remedial measures if necessary the safety of persons and property at any event held on property under control of the Board. .01 14 5.02 .02 It shall be the duty of the Director of the Department of Public Safety or his authorized subordinates to establish temporary restrictions upon access to or use of University buildings, parking lots, streets and highways or o ther p roperty of the Un iversity or portions thereof as may be deemed necessary or desirable for the convenient and efficient conduct of the affa irs of the University; provided that the Director of the Department of Public Safety or his authorized representatives shall make such restriction s known by use of signs, barricades, announcements, posting of police officers or other authorized persons possessing officia l id entificatio n , or establishing police lin es beyond which unauthorized persons are not per mitted to pass. 6.00- Misdemeanor- Penalty .01 - Whosoever shall refuse or fail to confo rm to such rules or regu lations, which may be prescribed by said Board in this ord inance, shall be deemed gu ilty of a misdemeanor, a nd upon convictio n thereof may be fined a nd/or imprisoned in the county j ail of the county wherein the offen se was com mitted, as provided by law. 7.00-Posting of Ordinances .01 - Copies of this ordinance, and all subsequent amendments thereto, shall be maintained, in conven ient form, in at least three (3) conspicuo us places on the lands governed by said Board. 8.00- Definitions .01 . 02 .03 . 04 . 05 .06 . 07 . 08 .09 - The te rm "ordinance" shall enco mpass on ly those rules and regula tions hereinafter prescribed . - The term "the Board" shall be co nsidered syno nymous with the terms "the State Board of Agriculture" and " the Board of Trustees of Michigan State University." - The term "Act 80" shall refer only to State of Michigan Public Act 80 of I 905, as amended . - The term "Public Safety Officer" sha ll include all ran ks within the or ganizational framework of the Depa rtme nt of Public Safety of Michigan State University and shall be considered synonymous with any other des criptive title normally assigned to those persons entrusted with th e exercis ing of police powers . - The singula r number, as used in this ord inance , includes the plural a nd the plural includ es the singular. - The masculine gender, as used in this ordinance, includes the feminine a nd neuter genders . - The terms "person," "accused," a nd similar words include, unless a contrary intention appears, public and private corporatio ns, co-partner ships , and unincorporated or voluntary associations . - The term "act" or "doing of an act" includes "omission to act. " - The word "property" includes a ny matter or thing upon or in respect to which any o ffe nse may be committed. 15 8.10 .10 .11 - The term "writing," "writte n," and any item of like import includes words or pictures printed, painted, engraved, lith ographed , photographed or otherwise copied, traced or made visible to the human eye in an y manner whatsoever. - The term "campus" as used in this ordinance shall be construed to in clude all property wheresoever situated, owned or held by the Board of Trustees in its capacity as the governing board of Michigan State University. 9.00-Aircraft .01 - No person shall land a irpl anes or helicopters except on the landing strip provided for that purpose. I 0.00-Athletic Equipment .01 - No person shall use athletic equipment or other equipmen t o r materials in a careless manner so as to enda nger life or property or to disturb the peace of individuals within the area. 11.00- Bicycles-Illegal Taking .01 .02 - No person shall take or use a bicycle without th e authority of the owner. - No person shall willfully or knowingl y assist or be a party to the un authorized taking of a bicycle. 12.00-Boating .01 - No person shall operate a boat propelled by a motor o n the Red Cedar River, or any other body of water, contiguous to or contained within any property under contro l of the Board of Trustees. 13.00-Buildings .01 . 02 - Th e Secretary of the Board of Trustees of Michigan State University is hereby empowered to establish regulations restricting or pro hibitin g access to and/or use of Univers ity buildings and property by employees and stude nts of the Uni vers ity a nd by me mbe rs of th e genera l public when such regul ations are deemed desirable for the co nve nient a nd efficie nt conduct of th e affairs of the University o r for the management a nd protectio n of its property; provided such regu lations must be posted at the e ntrances to the facility or portion of th e facility or building affected . - No person or persons shall willfully destroy o r d a mage or in any manner deface, destroy, or injure any property not his own, or any public building, bridge, fire hydrant, alarm box, street light, street sign, or shade tree belonging to Michigan State University, or mark or post hand bills on or in any manner mar the walls of any public building, or any fence, tree, or pole within the confines of Michigan State University, or take, or meddle with any property belonging to Michigan State University or re move the same from the building or place where it may be kept, placed, standing, or stored, without authority from the Secretary of the Board of Trustees o r his designated agent. 16 14.00 14.00- Camping .01 - No person shall construct or otherwise erect. or abide in any lean-to, vehicle, tra iler, tent, or oth er temporary shelter faci li ty anywhere within the confines of land governed by the Board. 15.00- Counterfeiting, Altering and Copying .01 . 02 . 03 - No person o r persons with intent to injure or defraud shall falsely ma ke, forge, manufacture, print, reproduce, copy, tamper with, or alte r , a n y writing, record, d ocument or identification used or maintained by Michigan State U niversity . - No person or persons shall knowingly possess, display or cause or permit to be displayed any writing, record , d ocu me nt or identification fo rm used or maintained by Michigan State University knowing the same to be ficti tious, altered, forged, counterfeited or made without proper authority . - No perso n or persons without proper authority shall knowingly possess, make , or cause to be made, any key, card, or unlocking d evice, to operate any lock or locking mechanism used or maintained by Michiga n State University . 16.00- Disorderly Assemblages or Conduct · .01 .02 .03 .04 .05 .06 .07 .08 - No person o r persons shall, without authorization, assemble together a nywhere on the campus for th e purpose of creating a ny noise or disturb a nce, riot, raid or other improper diversion, or asse mble in a manner which obstructs the free movement of perso ns about the ca mpus or the free and normal use of University buildings and facilities, or prevents or obstructs the normal operations of th e University. - No person or persons shall disrupt th e normal operation of a ny proper ly authorized class, laboratory. seminar, examination, field trip or other educational activity of the University. - No person or persons shall disrupt the normal use of any campus building or area which has been assigned or scheduled through appro priate channels for educational or extracurricular activities. Included with in, but not limited to the foregoing, is the use of appropriate buildings or areas for dramatic or musical presentations, lectu res, athletic events, mili tary exercises, orientation meetings, registration, co mmencement ceremo nies, a nd placement activities. - No person or persons shall use public address equipment, bullhorns, or other methods of sound amplification a nywhere upon the campus except through written approval in advance by the Secretary to the Board of Trustees. - No person or persons shall disrupt the normal activity or molest the property of a ny person, firm or agency while that person, firm or agency is carrying out the provisions of a contract or agreement with the University. - No unauthorized person or persons shall enter upon the playing area o f any athletic contest or exhibition while sa id contest or exhibition is in progress. - No person or persons shall project or drop any object which could cause injury, damage or interference in the spectator or playing area where any athletic contest or exhibition is conducted. - No person shall enter or attempt to enter into any dance or social, athletic, theatrical or other public event without a ticket of admission to such event when such tickets are required, or enter or attempt to enter 17 contrary to any established rules or qualifications for eligibility for attend ance at such events as provided by the sponsors. No person ineligible to attend such events shall loiter about the premises where such an event is being held. 17.00-Dumping .01 - No person shall deposit, dump or otherwise dispose of refuse of any kind on Michigan State University property. 18.00 - Examinations .01 . 02 . 03 - No person or persons shall take, steal, or otherwise procure in any un authorized manner any piece or pieces of writing which, as can be shown by competent authority, contain the questions or answers to an examination scheduled to be given, at some subsequent date, to any individual or group enrolled in any course of study offered by Michigan State University . - No person or persons shall sell, give away, lend or otherwise furnish to any unauthorized individual any piece or pieces of writing which, as can be shown by competent authority, contain the questions or answers to an examination scheduled to be given, at some subsequent date , to any indi vidual or group enrolled in any course of study offered by Michigan State University . - The unauthorized possession of any of the aforesaid writings shall be considered prima facie evidence of an attempt to violate the provisions of this section. 19.00-Firearms or Weapons .01 . 02 . 03 . 04 - No person shall possess any firearm or weapon anywhere upon the lands governed by said Board: Provided, however, that the provisions hereof shall not apply to such possession within the residences of those persons lawfully residing in the married housing facilities of the campus who fulfill all applicable requirements of the state statutes pertaining there to . - No person shall possess any chemical, or other dangerous substance or compound, with the intent of using the same to injure, molest or coerce another, anywhere upon the lands governed by the Board . - The use of any such device is prohibited anywhere upon the lands governed by the Board except those areas specifically set aside and super vised as range facilities, or as part of the regular educational process . - The provisions of this section shall not apply to the sworn police officers employed by the Department of Public Safety and other legally established law enforcement agencies. 20.00- Fires .01 - It shall be unlawful for any person or persons to set a fire upon the lands governed by said Board except in approved stoves amd grills in designated picnic areas or as required by University personnel in the dump area . 21.00-Curfew .0 l - No minor under the age of 17 years shall loiter, idle; or congregate in or on any public street, highway, alley, park or public building between the hours of IO o'clock p.m. and 7 o'clock a.m . unless the minor is accom panied by a parent or guardian or some adult delegated by the parent or guardian to accompany the child. 18 21.02 .02 - Any person of the age of 17 years or over assisting, aiding, abetting, allowing, permitting or encouraging any child under the age of 17 years to violate the provisions of Section 21.0 I shall be in violation of this Ordi nance. 22.00-Alcoholic Bever ages .01 - The use or possession of a lcoholic beverages, including beer and wine, subject to State law, is hereby permitted in housing facilities (rooms, suites, and apartments) assigned by Michigan State University . . 02 - The use or possession of alcoholic beverages is expressly prohibited in classrooms, lecture halls, laboratories, the libraries, the chapel and within buildings or arenas where athletic events, lectures, and concerts are held . . 03 - The use of alcoholic beverages is expressly prohibited in all public areas of campus buildings except as indicated in Sections 22.04 and 22.05 below . . 04 - The use of alcoholic beverages at non-student social events, subject to State law, is permitted in areas designated by, and with the approval of, the Office of the Secretary to the Board of Trustees . . 05 - The use of alcoholi c beverages at student social events, subject to State law, is permitted in areas designated by, and with the approval of, the Office of the Vice President for Student Affairs. 23.00- Model Airplanes .01 - No person shall fly model airplanes except in areas designated for that purpose. 24.00- Molesting .01 - No person shall accost, molest, or otherwise annoy, by word of mouth, whistle, sign or motion any person upon the lands governed by the Board. 25.00-Animals .01 - No person owning or having under his contro l any an ima l shall permit such anima l to be brought upon the property of Michigan State University without having a leash suitably attached to the an im a l and with the leash held by the person responsible . - No person sha ll bring any anima l into any Univers ity building . -No person shall bring any anima l into a University bus . . 02 . 03 . 04 -No person shall bring any a nimal into any University area such as the Beal Botanical Garden or the Horticulture Gardens when such areas are posted to prohibit the presence of anima ls . -Exceptions to the above provis ions shall include: .051 An im als used by blind persons for "seeing-eye" purposes . . 052 Animals brought for treatment to the Veterinary Medicine facilities or . 05 for University sponsored research . . 053 Animals being transported and which remain inside a vehicle such as a car, truck or trailer . . 054 Animals brought to events sponsored by Univers ity departments . . 055 Animals brought to events sponsored by registered student organiza tions which have received prior aut horizati on from the Office of the Secretary of the Board of Trustees . . 056 Other exceptions as authorized by the Office of the Secretary of the Board of Trustees in accord with Section 2.03. 19 26.00- Picnicking .01 - No person shall picnic on Michigan State University property in areas not designated a nd posted as picnic areas. Non-University groups of 25 or more must have written approval to use the facilities in accord with Section 2.03. 27.00-Plant Materials .01 It shall be unlawful for a ny person to break or cut branches or flowers - or fruit, or otherwise mutilate, any tree, shrub or herbaceous plant or re move therefrom any identification sign or tag. 28.00-Property: Lost, Found, Stolen or Abandoned .01 .02 . 03 It shall be the duty of the Director of the Department of Public Safety - of Michigan State University to maintain an accounting of all moneys, goods , wares and merchandise deposited in his office as lost or abandoned property which has been found within the campus of said institution. On the first secular day in the months of January, April, July, and October in each year , or more often as necessary, said Director of the Department of Public Safety shall cause a notice of all such property as shall remain un claimed to be posted in four conspicuous places on said campus for three successive weeks to all persons interested or claiming such property: Pro vided, however, that if any of such goods, wares, merchandise or chattels shall be of a perishable nature or expensive to keep, then it shall be lawful for said Director of Public Safety to sell the same at public auction at such time and after such notice as shall to him and the Board seem proper. - It shall be the duty of the Director of the Department of Public Safety, on receiving satisfactory proof of ownership, to deliver such property to the owner thereof on payment of all necessary and reasonable expenses which may have been incurred in the recovering, preservation or sustenance of such property and the expense of advertising the same unless the Uni sity Attorney or the Prosecuting Attorney of the County of Ingham shall otherwise direct . It shall be the duty of the Director of the Department of Public Safety - to cause all property unclaimed after the expiration of the notice specified in Section I, money excepted, to be sold at public auction to the highest bidder or through normal sales procedures established by the University salvage yard, unless the Prosecuting Attorney of the County of Ingham shall direct that it shall remain unsold for a longer period to be used as evidence in the administration of justice; and the proceeds thereof shall be forthwith paid to the University's Business Office together with all money, if any, which shall remain in his hands after such notice as aforesaid, first deducting actual charges of said sale. 29.00- Property Removal - No person shall remove any property from lands or buildings owned and operated by Michigan State University. Such property shall include books, films, documents, maps, charts, soil, plant material, construction materials, tools, vehicles, refuse or any other items having value or not that is owned by Michigan State University . - No person shall take or remove property owned by or in custody of Michigan State University from the custody or control of the University .01 . 02 20 0 29.02 department or agency responsible for its use and maintenance or to whose inventory it is assigned , without authorization of the head of that depart ment or agency or his designated subordinates, or without fo llow ing the regulations establi shed by appropriate University authority for borrowing such property . - The use of University equip ment or other property for other than Un i versity business is prohibited. . 03 30.00- Selling and Advertising .01 . 02 - No perso n , firm or corporation shall e ngage in the business of sellin g , hawking, or peddling any goods, wares, merchand ise or services, or ta ke orders or make co ntracts for the purchase or delivery thereof, either at the time or in the future , within "the boundaries of Michigan State University . - No person shall erect or otherwise display, except on his personal property, any sign or poster or distribute handbills upon property gov erned by the Board which advertises or othe rwise call s attentio n to any commercial product, service or activity. 31.00-Signs .01 . 02 . 03 - No person shall erect or otherwise display, except on bulletin boards erected by Michigan State Unive rsity, any sign or poster advertising or otherwise calling attention to any perso n or activity of the students or staff of Michiga n State U ni vers ity . - No person shall efface, alter, tamper with, destroy or remove any sign or inscription on any property governed by the said Board . - property other tha n a bulletin board governed by sa id Board. It shall· be unlawful for any person to a ttach any sign or poster to an y 32.00- Smoking - Smoking is hereby pro hibited : . .01 . Oll - In barns and farm buildings except where specifically approved for smoking by the Director of the Department of Public Safety . . 012 - In and adjacent to all buildings used primarily fo r storage of com bustible mate rials and/or flammable liquid s; provid ed, however, that all buildings and areas other than classrooms shall be clearly posted as "No Smoking" areas. 33.00-Telephones .01 . 02 .03 - It shall be unlawful for any person to telephone any other person re peatedly for the sole purpose of harassing or molesting such other person or his family, whether or not conversation ensues . - It shall be unlawful for any person to use a ny threatening, vulgar, indecent, obscene, immoral or insulting la ngu age over a ny telephone in strument or equipment. - It shall be unlawful to summon, as a joke or prank or otherwise, without any good reason thereof, by telephone or otherwise, the police or the fire department or a ny public or private ambula nce to go to any address where the service ca lled for is not needed. 21 34.00- Traffic - Rights and Duties of Drivers and Pedestrians .01 - Traffic-control signa ls (legend). Whenever traffic is controlled by traffic control signals, exhibiting different colored lights successively one at a time, or with arrows, the following colors shall be used and said lights shall in dicate and apply to drivers of vehicles and pedestrians as follows: .011 - GREEN alone: Vehicular traffic facing the signal may proceed straight through or turn right or left unless a sign at such place prohibits either such turn. But vehicular traffic, including vehicles turning right or left, shall yield the right-of-way to other vehicles and to pedestrians lawfully within the intersection or an adjacent crosswalk at the time such signal is exhibited . . 012 - GREEN alone: Pedestrians facing the signal may proceed across the roadway within any marked or unmarked crosswalk . . 013 - YELLOW alone (following a GREEN signal): Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at the intersection, but if such stop cannot be made in safety, a vehicle may be driven cautiously through the intersection . . 014 - YELLOW alone (following a GREEN signal): Pedestrians facing such signal are hereby advised that there is insufficient time to cross the roadway, and any pedestrian then starting to cross shall yield the right-of-way to all vehicles . . 015 - RED alone: Vehicular traffic facing the signal shall stop before entering the nearest crosswalk at an intersection or at such other point as may be indicated by a clearly visible line and shall remain standing until green is shown alone . . 016 - RED alone: No pedestrian facing such signal shall enter the street unless he can do so safe ly and without interfering with any vehicular traffic. .017 - GREEN ARROW (steady): Vehicular traffic facing such signal may cautiously enter the intersection only to make the movement indicated by such arrow but shall yield the right-of-way to pedestrians lawfully within a crosswalk and to other traffic lawfully using the intersection . . 018 - RED ARROW (flashing): When a RED ARROW is illuminated by rapid intermittent flashes, drivers of vehicles shall stop before entering the nearest crosswalk at an intersection or at a limit line when marked, and shall then be privileged to make the movement indicated, provided that no inter ference is offered pedestrians or vehicles lawfully on the street . . 02 . 019 - RED ARROW (flashing): No pedestrian facing such signal shall enter the street unless he can do so safely and without interfering with any vehicular traffic . - In the event a traffic-control signal is erected and maintained at a place other than an intersection, the provisions of this section shall be applicable except as to those provisions which by their nature can have no application. Any stop required shall be made at a sign or marking on the pavement indicating where the stop shall be made at the signal. - Pedestrian "WALK" and "WAIT" signals: Whenever special pedestrian control signals exhibiting the words "WALK," "DON'T WALK;' or "WA IT" are in place, such signals shall indicate as follows: .03 .031 - "WALK": Pedestrians facing such signal may proceed across the roadway in the direction of the signal and shall be given the right-of-way by the drivers of all vehicles . . 032 - "DON'T WALK" or "WAIT": No pedestrian shall start to cross the street in the direction of such signal but any pedestrian who has partially 22 34.032 . 04 .041 .042 . 05 .051 .052 .053 .054 .055 .06 .07 . 08 .09 completed his crossing on the "WALK" signal shall proceed to a sidewalk or safety island while the "DON'T WALK" or "WAIT" signal is showing . - Flashing RED or YELLOW signals: Whenever flashing RED or YEL LOW signals are used they shall require obedience by vehicular traffic as follows: - Flashing RED (stop signals): When a RED lens is illuminated by rapid intermittent flashes, drivers of vehicles shall stop before entering the near est crosswalk at an intersection or at a limit line when marked and the right to proceed shall be subject to the rules applicable after making a stop at a stop sign; - Flashing YELLOW (caution signal): When a YELLOW lens is illumi nated with rapid intermittent flashes, drivers of vehicles may proceed through the intersection or past such signal only with caution . - Signal indicating approach of train (stop required): Whenever any per son driving a vehicle approaches a railroad grade crossing under any of the circumstances stated in this section, the driver of such vehicle shall stop within 50 feet but not less than 15 feet from the nearest rail of such railroad, and shall not proceed until he can do so safely. The foregoing requirements shall apply when: - A clearly visible and positive signal gives warning of the immediate approach of a railway train or car; - A crossing gate is lowered or when a flagman gives or continues to give a signal of the approach or passage of a railroad train; - A railroad train approaching within approximately 1500 feet of the highway crossing emits a signal audible from such distance and such railroad train, by reason of its speed or nearness to such crossing, is an immediate hazard; - An approaching railroad train is plainly visible and is in hazardous proximity to such crossing; - No person shall drive any vehicle through, around, or under any cross ing gate or barrier at a railroad grade crossing while such gate or barrier is closed or is being opened or closed. - Stop signs: When stop signs are erected at or near the entrance to any intersection, every driver of a vehicle shall stop such vehicle at such sign or at a clearly marked stop line, except when directed to proceed by a pub lic safety officer or traffic-control signal and shall proceed into the inter section only when such movement can be made in safety and without inter fering with other traffic. - Emerging from alley, private road or driveway: The driver of a vehicle about to enter or cross a highway from an alley, private road or driveway shall come to a full stop and yield right-of-way to all vehicles or pedestrians approaching on said highway so close to such point of entry as to constitute an immediate hazard . - Obstructing intersection: Notwithstanding any traffic-control signal indication or other right to proceed, no driver shall enter an intersection or a marked crosswalk unless there is sufficient space on the other side of the intersection or crosswalk to accommodate his vehicle without obstruct ing or blocking the passage of other vehicles or pedestrians. - Passing stopped vehicle at intersection: Whenever any vehicle is stopped at a marked crosswalk or at any unmarked crosswalk at an intersection to permit a pedestrian to cross the roadway, the driver of any other vehicle approaching from the rear shall not overtake and pass such stopped vehicle. .10 .101 Right-of-Way (at intersection): When two vehicles enter an· open intersection at approximately the same 23 34.101 .102 .103 time, the driver of the vehicle on the left shall yield the right-of-way to the vehicle on the right. The driver of any vehicle traveling at an unlaw ful speed shall forfeit any right-of-way which he might otherwise have h ereunder; - The driver of a vehicle within an intersection intending to turn to the left shall yield the right-of-way to any vehicle approaching from the op- posite direction which is within the intersection or so close thereto as to constitute an immediate hazard , but said driver, having so yielded and hav ing given a signal when and as required by this ordinance, may make such left turn and the drivers of all other vehicles approaching the intersection from said opposite direction shall yield the right-of-way to the vehicle mak ing the left turn : Provided, that at an intersection at which a traffic signal is located, a driver intending to make a left turn shall permit vehicles bound straight through in the opposite direction which are waiting a "Go" signal to pass through the intersection before making the turn; - When the intersection is designated as a "Yield Right-of-Way" inter section, the driver of a vehicle approaching said sign shall slow to a reason- able speed for existing conditions of traffic and visibility, yielding the right of-way to all vehicles on the interse cting street or highway which have entered the intersection or are so close as to constitute an immediate hazard. If a driver is involved in a collision at an intersection or interferes with the movement of other vehicles after failure to heed and driving past a "Yield Right-of-Way" sign, such collision or interference shall be deemed prima facie evidence of the driver's failure to yield right-of-way . 35.00-Driving in Roadway-Following, Overtaking .01 and Passing - Upon all roadways of sufficient width a vehicle shall be driven upon the right half of the roadway, and on highways with four or more lanes, within the extreme right hand lane, except as follows: .011 - When overtaking and passing another vehicle proceeding in the same direction under the rules governing such movement; .012 - When the right half of a roadway is closed to traffic while under con struction or repair; .013 - Upon a roadway divided into three lanes for traffic under the rules applicable thereon; .014 - Upon a roadway designated and signposted for one-way traffic; .015 - Upon a roadway that has a lane marked and designated for the use of bicycles . - Drive within marked traffic lane: It shall be a violation of this ordinance for the operator of any vehicle to fail or refuse to keep such vehicle within the boundaries of any legally marked traffic lane except when lawfully passing another vehicle or preparatory to making a lawful turning move ment. - Following too closely: The driver of a motor vehicle shall not follow another vehicle more closely than is reasonable and prudent, having due regard for the speed of such vehicles, and the traffic upon and the condi tion of the streets . - Following fire apparatus prohibited: The driver of any vehicle other than an authorized emergency vehicle on official business shall not follow any fire apparatus traveling in response to a fire alarm closer than 500 feet or drive into or park such vehicle within 500 feet where fire apparatus has stopped in answer to a fire alarm . - Passing vehicles proceeding in opposite directions: Drivers of vehicles . 02 .03 . 04 . 05 24 ,35.05 proceeding in opposite directions shall pass each other to the right, and upon roadways having width for not more than one la ne of traffic in each direction each driver shall give to the other at least one-half of th e main traveled portion of the roadway as nearly as possible . - The following rules shall govern the overtaking and passing of vehicles proceeding in the same direction, subject to those limitations, exceptions, a nd special rules hereinafter stated: . 06 .061 - The driver of any vehicle overtaking another vehicle proceeding in the same direction shall pass at a safe distance to the left thereof, and when safely clear of such overtaken vehicle shall take up a position as near the right-hand edge of the main-traveled portion of the highway as is practic able; .062 - Except when overtaking and passing on the right is permitted, the driver of an overtaken vehicle shall give way to the right in favor of the overtaking vehicle on audible signal and· shall not increase the speed of his vehicle until completely passed by the overtaking vehicle . - The driver of a vehicle may overtake and pass upon the right of another vehicle only under the following conditions: . 07 .071 - When the vehicle overtaken is making or about to make a left turn; .072 - Upon a street or highway with unobstructed pavement not occupied by parked vehicles of sufficient width for two or more lines of moving vehicles in each direction and when such vehicles are moving in substantially con tinuous lanes of traffic; .073 - Upon a one-way street, or upon any roadway on which traffic is re stricted to one direction of movement, where the roadway is free from obstructions and of sufficient width for two or more lines of moving ve hicles and when such vehicles are moving in substantially continuous lanes of traffic; .074 - The driver of a vehicle may overtake and pass another vehicle upon the right only under conditions permitting such movement in safety. In no event shall such movement be made by driving off the pavement or main traveled portion of the roadway . . 08 . 09 . 10 . 11 It shall be unlawful to overtake or pass any vehicle in a designated "no - No vehicle shall be driven to the left side of the center of a two-lane (or any multiple thereof) highway or in the center lane of a three- or five-lane lane highway in overtaking and passing another vehicle proceeding in the same direction unless such left side or center lane is clearly visible and is free of on-coming traffic for a sufficient distance ahead to permit such over taking and passing to be completely made without interfering with the safe operation of any vehicle approaching from the opposite direction or any vehicle overtaken. The foregoing limitation shall not apply upon a one-way roadway . - passing" zone . - Driving on three-lane roadway: Upon a roadway which is divided into three lanes a vehicle shall not be driven to the left of the center lane except when making a left turn and shall not be driven in the center lane except when overtaking and passing another vehicle where the roadway is clearly visible and such center lane is clear of traffic within a safe distance, or in preparation of a left turn or where such center lane is at the time allocated exclusively to traffic moving in the direction the vehicle is proceeding and is signposted to give notice of such allocation . - Driving on one-way streets, alleys and rotary traffic islands: Vehicular traffic shall move only in the indicated direction upon those streets and parts of streets and in those alleys and in those roadways around rotary traffic 25 35.11 .13 .12 islands where signs have been erected indicating traffic shall move in only one direction. A vehicle passing around a rotary traffic island shall be driven · only to the right of such island. - No person shall drive any motor vehicle upon other than established roadway or parking area. - No person shall operate any bicycle upon other than establish ed road ways, parking areas or bicycle paths . - No person shall ride any animal upon other than an established road way, parking area or brid le path . - The provisions of 35.12, 35.13 and 35.14 shall not apply when a public safety officer shall direct otherwise. 36.00- Turning Movements . 15 . 14 ' .01 . 02 . 03 - Signals for turning: The driver of any vehicle upon a street before start ing, stopping or turning from a direct line shall first see that such move ment can be made in safety and shall give a signal as required in this section . - Signals for turning: The signal herein required shall be given either by means of the hand and arm in the manner herein specified or by a mechan ical or electrical signal device which conveys an intelligible signal or warn ing to another driver approaching from the rear. Whenever the signal is given by means of the hand and arm, the driver shall indicate his intention to turn by extending the hand and arm horizontally from and beyond the left side of the vehicle . - Position for turning: The driver of a vehicle intending to turn at an intersection, alley or driveway shall do so as fo llows: .031 - Both the approach for a right turn and a right turn sha ll be made as close as practicable Lo the right-hand curb or edge of the roadway; .032 - Approach for a left turn shall be made in that portion of the right half of the roadway nearest the center line thereof and after entering an inter section the left turn shall be made so as to leave the intersection to the right of the center line of the roadway being entered; .033 - Approach for a left turn from a two-way street into a one-way street sha ll be made in that portion of the right half of the roadway nearest the center line thereof and by passing to the right of such center line where it enters the intersection. A left turn from a one-way street into a two-way street sha ll be made from as close as practicable to the left-hand curb or edge of the roadway and by passing to the right of the center line of the street being entered upon leaving the intersection . . 04 . 034 - Where both streets or roadways are one-way, both the approach for a left turn and a left turn shall be made as close as practicable to the left hand curb or edge of the roadway . - Signs limitin g turn: When pavement markers, signs or signals placed within or adjacent to intersections require and direct that a different course from that specified in this article be traveled by vehicles turning at an in tersection, no driver of a vehicle shall turn a vehicle at such an intersection other than as directed by such markers, signs, or signals; and then only when such movement can be made in safety and without interfering with other traffic. 37.00-Speed Regulations .01 . 02 - No person shall drive a vehicle on a highway at a speed greater than is reasonable and prudent under the conditions then existing . - Where no special hazard exists, the following speeds shall be prima facie lawful, but any speed in excess of said limits shall be prima facie evidence 26 37.02 .021 .022 .023 . 03 . 04 that the speed is not reasonable or prudent and is unlawful: 25 miles per hour in any school district; 15 miles per hour in any residential district; Any other number of miles per hour when and as posted . The fact that the speed of a vehicle is lower than the foregoing prima facie limits shall not relieve the driver from the duty to decrease speed when approaching and crossing an intersection. when approaching and going around a curve, when approaching a hill crest, when traveling upon any narrow or winding roadway, or when special hazards exist with respect to pedestrians or other traffic or by reason of weather or highway condi tions, and speed shall be decreased as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the highway in compliance with legal requirements and the duty of all persons to use due care . - In every charge of violation of the provision of this section, by driving a vehicle in excess of the applicable speed limits specified under subsection .02 of this section, the complaint, and also the summons or notice to appear, shall specify the speed applicable within the district or at the location , and in the event charges shall also be made of violation of any other provisions of this act, the complaint and the summons or notice to appear shall also specify such other offense alleged to have been committed. 38.00- School Bus - Overtaking, Meeting, and Passing Stopped Bus, Signs on Bus .01 . 02 . 03 .04 - The driver of a vehicle shall not overtake or meet and pass any school bus which has stopped for the purpose of receiving or discharging passen gers. All school buses shall contain such signs on the back and front thereof, with respect thereto, as shall be approved by the State Highway Commis s10ner . - The driver of a vehicle overtaking or meeting any school bus which has stopped for the purpose of receiving or discharging any passenger shall bring such vehicle to a full stop at least IO feet from the school bus and shall not proceed until the school bus resumes motion or the school bus driver signals to proceed or the visual signals are no longer actuated. The driver of the school bus, before resuming motion, shall signal stopped traffic to proceed and shall when resuming motion proceed in such a man ner as to allow congested traffic to disperse by keeping the bus as near to the right side of the road as can be done with safety. Passengers crossing the road upon being discharged from a school bus shall cross in front of the stopped school bus. At an intersection where traffic is controlled by an officer or a traffic stop and go signal, a vehicle need not be brought to a full stop before passing any such school bus, but may proceed to pass such school bus at a speed not greater than is reasonable and proper and in no event greater than 10 miles an hour and with due caution for the safety of the passengers being received or discharged from such school bus . - No school bus driver shall stop his bus upon the highway for the purpose of receiving or discharging passengers unless such bus is clearly visible in a stopped position to approaching or overtaking drivers of vehicles for a distance of at least 500 feet. - The driver of a vehicle upon any highway which has been divided into two roadways by leaving an intervening space, or by a physical barrier, or clearly indicated dividing sections so constructed as to impede vehicular 27 38.04 . 05 traffic, need not stop upon meeting a school bus which has stopped on the roadway across the dividing space , barrier, or section . - Every school bus shall, in addition to any other ,equipment and distinc tive markings required by law, be equipped with signal lamps mounted as high and widely spaced laterally as practicable which shall be capable of displaying to the front two alternately flashing red lights at the same level and to the rear two alternately flashing red lights located at the same level. The red lights shall be no less than 6 inches in diameter and shall have sufficient intensity to be visible from a distance of at least 500 feet in normal sunlight and shall be actuated by the driver of the said school bus whenever but only whenever said vehicle is stopped or is about to stop for the purpose of receiving or discharging school children. 39.00- Parking .01 . 02 .03 . 04 . 05 . 06 . 07 - Except as otherwise provided in this section, every vehicle stopped or parked upon a highway shall be so stopped or parked with the wheels of such vehicle parallel to the roadway and within 12 inches of any existing right-hand curb . - Obedience to angle-parking signs or markings: Upon those streets or in those parking lots which have been signed or marked by the Traffic En gineer or Director of Public Safety for angle parking, no person shall stop, stand or park a vehicle other than at the angle to the curb or edge of the roadway indicated by such signs or markings, and no person shall stop, stand or park a vehicle except completely within such pavement markings as may exist. - Unattended motor vehicle: No person having control or charge of a motor vehicle shall allow such vehicle to stand on any highway or in any parking lot unattended without first effectively setting the brakes thereon and stopping the motor of said vehicle and when standing upon any grade without turning the front wheels of such vehicle to the curb or side of high way; nor shall any person leave any motor vehicle unattended upon any street or in any parking lot without removing the keys from the ignition of said vehicle . - Parking not to obstruct traffic: No person shall park any vehicle upon a street or in any parking lot in such a manner.or under such conditions as to leave available insufficient width of the roadway for free movement of vehicle traffic or so as to require vehicles operating upon the roadway to leave their assigned traffic lane in order to pass such parked vehicle . - A vehicle starting from a parked position shall give moving vehicles the right-of-way and the operator of such vehicle shall give a timely and visible warning signal before so starting . - A vehicle parked at an angle to the curb and about to start shall give moving vehicles the right-of-way and the operator thereof shall not back such vehicle from the curb into the moving lane of traffic unless such maneuver can be made in safety and without conflict with moving vehicles, and shall not back such vehicle to cause other traffic to yield right-of-way to avoid a collision . - Whenever a vehicle is parked upon a street or highway during the hours between one-half hour after sunset and one-half hour before sunrise, and at any other time when there is not sufficient light to render clearly dis cernible persons and vehicles on the highway at a distance of 500 feet ahead, there shall be displayed upon the left side of such vehicle one or more lamps which shall exhibit a white light on the roadway side visible from a distance 28 39.,07 . 08 . 09 of 500 feet to the front of the vehicle and a red light visible from a distance of 500 feet to the rear . - Any lighted headlights upon a parked vehicle shall be depressed or dimmed . - Prohibitions (no signs required): No person shall stop or park a vehicle, except when necessary to avoid conflict with other traffic or in compliance with law or the directions of a public safety officer or traffic-control device, in any of the following places: .091 .092 .093 .094 .095 .096 Within 20 feet of a crosswalk, or if none, then within 15 feet of the inter On a sidewalk; In front of a public or private driveway; Within an intersection; Within 15 feet of a fire hydrant; On a crosswalk; section of property lines at an intersection of highways; .097 - Within 30 feet upon the approach to any flashing beacon, stop sign, yield right-of-way sign or traffic-control signal located at the side of the highway or roadway; .098 - Between a safety zone and the adjacent curb or within 30 feet of points on the curb immediately opposite the ends of a safety zone, unless a dif ferent length is indicated by signs or markings; .099 - Within 50 feet of the nearest rail of a railroad crossing; .0910- Within 20 feet of the driveway entrance to any fire station and on the side of a street opposite the entrance to any fire station within 75 feet of said entrance when properly signposted; .0911- Alongside or opposite any street excavation or obstruction when such stopping, standing, or parking would obstruct traffic; .0912- On the highway side of any vehicle stopped or parked at the edge or curb of a street; .0913- Upon any bridge or other elevated structure upon a highway or within a highway tunnel; .0914- Within 200 feet of an accident at which public safety officers are in at tendance; . 11 . IO .0915- In front of any theater; .0916- In any place or in any manner so as to block immediate egress from any emergency exit or exits conspicuously marked as such on buildings; .0917- In any place or in any manner so as to block or hamper the immediate egress from any fire escape conspicuously marked as such providing an emergency means of egress from any building . - Motor buses, for the purpose of taking on or discharging passengers, may be stopped at the places designated in Sections 39.092 , 39.094 and 39.096 of this ordinance, or on the highway side of a vehicle illegally parked in a legally designated bus loading zone . - No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful. - No person shall drive a motor vehicle or park such vehicle upon the grass or over a curb or beyond the designated highway width or off the shoulder of a highway unless otherwise directed to do so by a public safety officer . - Prohibitions and restrictions (signs required): No person sha ll stop, stand, or park a vehicle, except when necessary to avoid conflict with traffic or in compliance with law or the direction of a public safety officer, in violation of any legally established parking restriction or prohibition , pro vided that signs stating such restrictions or prohibitions are duly posted in accordance with this ordinance. .12 . 13 29 39.14 .14 - No person shall park a vehicle upon any street for the principal purpose of: .141 - Displaying such vehicle for sale; .142 - Washing, polishing, greasing, or repairing such vehicle, except repairs necessitated by an emergency; .143 - Displaying advertising; .144 - Selling merchandise from such vehicle except in a duly established market place, or when so authorized or licensed under this ordinance; . 16 .145 - Storage for more than 48 continuous hours . . 15 - No person shall park or store mobile homes, trailers, boats or similar property in other than areas designated and posted for such purposes . - Alley: No person sha ll park a vehicle in a public alley, except when authorized by signs posted at the direction of the Traffic Engineer, nor sha ll he stop or stand a vehicle in a public alley except whi le actually in the process of loading or unloading a vehicle . - Metered parking zones: . 17 .171 - When parking meters are erected adjacent to a space marked for park ing, such space shall be a metered parking zone and no person shall stop a vehicle in any such zone for a period of time lon ger than designated on said parking meters upon the deposit of a coin of the United States cur rency of the denomination designated on said meters on any day except Sundays and legal holidays as defined herein, except government-owned vehicles sha ll be exempt from the payment of the meter fee; .172 - Every vehicle shall be parked wholl y within the metered parking space . 18 . 19 . 20 . 21 for which the meter shows parking privilege has been granted . - When parking gates are installed to restrict use of a parking area or parking lot, no person sha ll use such area without depositing the coin of United States currency of the denomination designated on said parking gate and accord ing to the operating instructions designated on the parking gate . - No person shall drive or attempt to drive a vehicle through parking lot entrances or exits contro lled by parking gates except in the manner posted and indicated by the nature of the operation of the parking gate . - No person shall drive or attempt to drive a vehicle into a parking lot through the "exit" side of the parkin g gate or drive a vehicle from a park ing lot through the "entrance" side of the parking gate unless directed to do so by a public safety officer . - No person sha ll by any means whatsoever cause or attempt to cause the mechanism of a parking gate to operate unless that person shall be driving a vehicle through a parking lot entrance controlled by that parking gate and then sha ll cause the mechanism to operate in only its normal and in tended manner and as provided elsewhere in th is section . - Loading and unloading only: . 22 .221 - Standing in passenger loading zone: No person sha ll stop, stand, or park a vehicle for any purpose or period of time except for the expeditious load in g or unloading of passengers in any place marked as a passenger loading zone during hours when the regulations applicable to such passen ger load ing zone are effective and then only for a period not to exceed 5 mmutes; .222 - No person shall stop, stand or park a vehicle for any purpose or length of time other than for the exped itious unloading and delivery or pick up and loading of materials in any place marked as a freight load in g zone during hours when the provisions applicable to such zones are in effect; .223 - The driver of a vehicle may stop temporarily at a place marked as a 30 39.223 . 23 . 24 . 25 . 26 . 27 freight loading zone for the purpose of and while actually engaged in load ing or unloading passengers, when such stopping does not interfere with any motor vehicle used for the transportation of materials which is waiting to enter or about to enter such zone . - Stopping, standing or parking of buses and taxicabs regulated: The operator of a bus or 1axicab shall not stop, stand or park upon any street in any business district at any place other than at a bus stop or taxicab stand, respectively, except that this provision shall not prevent the operator of any such vehicle from temporarily stopping in accordance with other stop ping, standing or parking regulations at any place for the purpose of and while engaged in the expeditious unloading or loading of passengers . - Restricted use of bus and taxicab stands: No person shall stop, stand or park a vehicle other than a bus in a bus stop or other than a taxicab in a taxicab stand when such stop or stand has been officially designated and appropriately signed, except that the driver of a passenger vehicle may tem porarily stop therein for the purpose of and while actually engaged in the expeditious loading or unloading of passengers when such stopping does not interfere with any bus or taxicab waiting to enter or about to enter such zone . - In any proceeding for violation of the parking provisions of this or dinance, the registration plate and/or university permit displayed on such motor vehicle shall constitute in evidence a prima facie presumption that the owner of such motor vehicle was the person who parked or placed such motor vehicle at the point where such violation occurred . - No parking tow-away zone: The Traffic Engineer or Director of Public Safety may establish temporary or permanent "No Parking" zones in which, by posting of "Tow-away Zone" signs, vehicles parked in violation may be towed away and impounded . - No person shall open the door of a motor vehicle on the side adjacent to moving traffic unless and until it is reasonably safe to do so, nor shall any person leave a door open on the side of a motor vehicle next to moving traffic for a period of time longer than necessary to load or unload passen gers. 40.00- Miscellaneous Rules .01 - Driver's license: No person shall drive any motor vehicle upon a street within the boundaries of Michigan State University unless such person is licensed as an operator or chauffeur as required by Michigan Vehicle Code, Act 300, Public Acts of 1949, as amended . . 011 - Every operator of a motor vehicle shall at all times have in his immedi ate possession when driving a motor vehicle his operator's or chauffeur's license. The certificate of registration shall at all times be carried in the ve hicle to which it refers or shall be carried by the person driving or in con trol of such vehicle. The license or certificate shall be submitted for ex amination upon demand by any public safety officer; .012 - Lt shall be unlawful for any person to display or cause or permit to be displayed or to have in possession any operator's or chauffeur's license knowing the same to be fictitious, or to have been canceled, revoked , sus pended, or altered; to lend or to knowingly permit use of, by one not en titled thereto, any operator's or chauffeur's license issued to the person so lending or permitting the use thereof; to display or to represent as one's own any operator's or chauffeur's license not issued to the person so dis playing the same; 31 40.013 · -=-:" .013· - It shall be unlawful for an operator holding ·an instruction permit to operate a motor vehicle unless accompanied by a licensed operator or chauf feur who is actually occupying a seat beside the driver; .014 - It shall be unlawful for the owner of a motor vehicle to knowingly . 02 . 03 . 04 . 05 . 06 .07 . 08 . 09 .10 . 11 .12 authorize or permit any unlicensed driver to drive such vehicle . - License plates, No person shall operate a motor vehicle on the streets within the boundaries of Michigan State University without having his motor vehicle equipped with license plates as provided in the Michigan Vehicle Code, Act 300, Public Acts of 1949, as amended . - Reckless driving: Any person who drives any vehicle upon a street, side walk, parking area or structure, recreation, lawn or farm area or within any building carelessly and needlessly in willful or wanton disregard of the rights or safety of others, or without due caution and circumspection and at a speed or in a manner so as to endanger or be likely to endanger any per son or property, shall be guilty of reckless driving . - Drivers to exercise due care: Every driver of a vehicle shall exercise due care to avoid colliding with any pedestrian, vehicle or other object upon any roadway, area adjacent to any roadway or area open to motor vehicles and shall give warning by sounding the horn when necessary . - It shall be unlawful for any person, whether licensed or not, who is an habitual user of narcotic drugs, barbital or any derivative of barbital, or any person who is under the influence of intoxicating liquor or narcotic drugs, barbital or any derivative of barbital, to drive any vehicle upon any street or any other place within the boundaries of Michigan State University . - It shall also be unlawful for the owner of any motor vehicle or any per son having such in charge or in control thereof to authorize or knowingly permit the same to be driven or operated upon any street or any other place within the boundaries of Michigan State University by any person who is an habitual user of narcotic drugs, barbital or any derivative of bar bital or any person who is under the influence of intoxicating liquor or narcotic drugs, barbital or any derivative of barbital. - Driver regulations applicable: Every person operating a motorcycle or motor-driven cycle upon a roadway shall be granted all the rights and shall be subject to all the duties applicable to the driver of a vehicle under this _ ordinance except as to those provisions which by their nat1:1re can have no application . - The operators of motorcycles or motor-driven cycles shall not ride more than two abreast on any roadway and shall comply with the seating and con trol requirements prescribed for bicyclists in Sections 43.07 and 43.08 . - Spotlights: A motorcycle shall not be equipped with more than one spot lamp, and every lighted spot lamp shall be so aimed and used upon approaching another vehicle that no part of the beam will be directed into the eyes of the approaching driver. Spotlights may not emit other than either a white or amber light. - Every person riding animals or driving any animal drawing a vehicle upon a street shall be subject to the provisions of this ordinance applicable to the driver of a vehicle, except those provisions of this ordinance which by their nature can have no application . - Persons riding or leading animals on or along any street shall ride or lead such animals on the left side of said street facing approaching traffic. - No person shall use the streets for traveling on skis, toboggans, coasting sleds or similar devices. No person shall use any roadway within the boun daries of Michigan State University as a sled or ski course for the purpose of coasting on sleds, skis, or other similar devices except on portions of 32 40.12 . 13 . 14 such streets officially set aside for such use and adequately roped off or otherwise marked for such purpose . - Driving through funeral or othe r procession: No operator of a vehicle shall drive through the vehicles, persons, or animals comprising a funeral or other authorized procession while such funeral or procession is in motion except when otherwise directed by a public safety officer. This provision shall not apply to authorized emergency vehicles . - Permits required for parades, processions, and sound trucks: No funeral , procession, or parade, excepting the forces of the United States Armed Services, the military forces of this State, and the forces of the police and fire departments shall occupy, march or proceed along any street or road way except in accordance with a permit and such other regulations as are set forth herein which may apply. No sound truck or other vehicle equipped with amplifier or loudspeaker may be used unless written authorization is obta ined as indicated in Section 2.03 . - Backing: The driver of a vehicle shall not back said vehicle: . 15 .151 - Unless such movement can be made with safety and without interfering with other traffic; .152 - Under such circumstances as to cause other traffic to yield right-of-way to avoid a collision; .153 - Through or into any intersection of two or more roadways . . 16 - Vehicles shall not be driven on a sidewalk or footbridge. The driver of. a vehicle shall not drive upon or within any sidewalk area or footbridge except at a driveway . - Driving through safety zones prohibited: No vehicle sha ll at any time be driven through or within an occupied safety zone . - Splashing: No person shall recklessly, wilfully , wantonly or carelessly operate his vehicle in such manner as to splash snow, rain, water , mud, dirt, or debris on any person then upon a sidewalk or crosswalk . - Leaking or spilling: No vehicle shall be driven or moved on any street unless such vehicle is so constructed or loaded as to prevent its contents from dropping, sifting, leaking, or otherwise escaping therefrom . - Crossing fire hose: No vehicle shall be driven over any unprotected hose of a fire department without the consent of the fire department official in command . - Coaster, roller skates and simi lar devices restricted: No person upon roller skates, or riding in or by means of any coaster, toy vehicle or similar device, sha ll go upon any roadway except while crossing a street on a cross walk, and when so crossing such person shall be granted all of the rights and shall be subject to all of the duties applicable to pedestrians. This sec tion shall not apply upon any street while set aside as a play street as pro vided for in this ordinance . - Clinging to vehicles: No person riding upon any bicycle, motorcycle, motor-driven cycle, coaster, sled, roller skates or any toy vehicle shall at tach the same or himself to any vehicle upon any street. - Boarding or alighting from vehicles: No person shall board or alight from any vehicle while such vehicle is in motion . - Restrictions on trucks and commercial vehicles upon use of streets: When signs are erected giving notice thereof, no person shall operate or stop, stand or park any truck or commercial vehicle with a gross weight in excess of the amounts specified thereon at any time upon any of the streets or parts of streets on which such signs have been posted . - Lamp or flag on projecting load : Whenever the load upon any vehicle extends to the rear 4 feet or more beyond the bed or body of such vehicle, there shall be displayed at the extreme rear end of the load, during the . 17 . 18 . 19 . 20 . 21 . 22 .23 . 24 . 25 33 40.25 hours between one-half hour after sunset and one-half hour before sunrise, and at any other tim e when th ere is not sufficient li~ht to render clea rly discernible persons and vehicles on the highway at a distance of 500 fee t ahead, a red light or lantern plainly visible from a distance of at least 500 feet to the sides and rear. The red light or lantern required under this sec tion shall be in addition to the red rear light required upon every vehicle. At any other time there shall be displayed at the extreme rear end of such load a red Aag or cloth not less than 12 inches square and so hung that the entire area is visible to the driver of a vehicle approaching from the rear. - No person shall drive a vehicle when it is so loaded, or when there are in the front seat such number of persons as lo obstruct the view of th e driver to the front or sides of the vehicle or as to interfere with the driver's control over the driving mechanism of the vehicle . - No passenger in a vehicle shall ride in such position as to interfere with the driver's view ahead or to the sides, or to interfere with his control over the driving mechanism of the vehicle . - No person in a bus, trolley coach, or other transit vehicle shall stand beyond the safety line which shall be inlaid, constructed in the Aoor or painted upon the floor so as to interfere with or obstruct the driver's view to the front or sides, or to obstruct the view of signals he may give to drivers of other vehicles . - No person shall drive any motor vehicle with a window so damaged or with any sign, poster or other non-transparent material upon the front windshield, sidewings, side or rear windows of such vehicle so as to obstruct the driver's view, other than a certificate or other paper required to be so displayed by law . - No vehicle shall be operated upon any street unless the driver's vision through any required equipment is normal and unless such vehicle complies with the provisions of Section 41.00 . - No owner shall display upon any part of his vehicle or knowingly per mit the display thereon of any official designation, sign, or insignia of any public or quasi-public corporation, municipal, state or national department or government subdivision without authority of such agency . - Any person who drives any vehicle upon a street, sidewalk, parking area or structure, recreation area, lawn or farm area or within any building carelessly and heedlessly , but without wantonness or recklessness, in a manner so as lo endanger or be likely to endanger any person or property shall be guilty of driving in an unsafe manner. .26 . 27 . 28 . 29 . 30 . 31 . 32 41.00- Equipment .01 . 02 . 03 34 - No person shall drive or move and no owner shall cause or knowingly permit to be driven or moved on any street or any other place upon prop erty governed by the Board any vehicle or combination of vehicles which is in such unsafe condition as to endanger any person or which does not contain those parts or is not at all times equipped with such lamps and other equipment in proper condition and adjustment as required by this section , or which is equipped in any manner in violation of this section . - Every motor vehicle shall at all times be equipped with a muffler in good working order and in constant operation to prevent excessive noise and annoying smoke, and no person shall operate on the streets a motor ve hicle equipped with a muffler cut-out, by-pass or similar device, or a device for the purpose of causing flame or smoke to be emitted from a vehicle, except a highway maintenance vehicle . - The engine and power mechanism of every motor vehicle shall be so equipped and adjusted as to prevent the escape of excessive fumes or smoke. 41.04 .04 . 05 . 06 .07 .08 . 09 .10 . 11 No person shall introduce any gasoline, foreign material or obstru ction into the muffl er or ex hau st pipe which ca uses 01· is capable of ca using ex haust gases fo ignite, burn, or flash in any manner or form . - Lights: Every vehicle upon a street within the boundaries of Michigan State University shall be equipped with lights which shall be li ghted in ac cordance with the provisions of the Michigan Vehicle Code, Act 300, Public Acts of Michigan, 1949, as amended . - Spot lamps: Any motor vehicle may be equipped with not to exceed two spot lamps, and every li ghted spot lamp shall be so aimed and used upon approaching another vehicle that no part of the beam will be directed into the eyes of th e ap proachin g driver. Spot lamps may not e mit other than either a white or amber li ght. - Flashing, RED and GREEN lights: No vehicles except those authorized by law shall disp lay a ny flashing light exce pt directional signa ls , or a red li ght to th e front or a green light to the rea r. - Brakes: Every motor vehicle or co mbination of motor-drawn vehicles wh e n operated upon a street or any other place within the boundaries of Michigan State Univers ity shall be equipped with brakes of such construc tion and capable at all times and under all conditions of stopping the ve hicl e in such mann e r as required by the Michigan Vehicle Code, Act 300, Public Acts of Michigan , 1949, as amended . - Horns: Every motor vehicle when being operated shall be equipped with a horn in good working order and capable of emitting sound audible under normal cond itions from a dista nce of not less th a n 200 feet , but no horn or other warn in g device shall emit an unreasonabl e loud or harsh sound or a whistle. The driver of a motor veh icl e shall , when reasonably necessar y to insure safe operation, give audible warning with his horn but sha ll not otherwise use such horn when upon a street. - Obstruction to view : No pe rson shall drive any motor vehicle with any sign, poster or other non -transparent. material upon the front windshield, sidewings or side of rea r windows of such veh icl e which obstructs the driver's clear view of the highway or other suspended object as authorized by la w, which in any way obstructs the vision of the driver of th e veh icle . - Windshield wiper: The windshield of every motor vehicle shall be equipped with a device for cleaning ra in, snow or other moisture from the windshield , wh ich device shall be so constructed as to be controlled by the driver of the ve hicle and sha ll be continuous ly se lf-operatin g after having bee n actuated by the driver of the ve hicle . . lll - Every windshield wipe r upon a motor vehicle shall be maintained in .12 . 13 good working o rd er. - Windshield washer: No motor vehicle li censed as su ch an manufac tured after January l , 1956, sha ll be operated on the streets or property of Michigan State University unless it is equipped with a windshield washer maintained in operable cond ition at all times and capable of cleaning the windsh ield in such a fash ion as to leave the driver with a clear view of the highway or any intersecting highway . - Tires : No motor truck , tractor, trailer or sem i-trailer sha ll be operated on the paved a reas of th e property governed by the Board if the tires are equ ipped with metal that comes in contact with the surface of the road or whi ch have a partial contact of metal with the surface of th e road . . 131 - No tire on a vehicle moved on any paved area shall have on its periphery an y block, stud, flange , cl ea t, or spike or any other protuberance of any m aterial other than rubber which projects beyond the thread of the trac tion surface of the tire , except that it sha ll be permissible to use farm ma- 35 41.13 . 14 . 15 chinery with tires having protuberances which will not injure the highway, and except a lso that it sha ll be permissible to use tire chains of reasonable proportions upon any vehicle when required for safety because of snow, ice, or other conditions tending to cause a veh icl e to skid . - View to rear, mirrors: No person shall drive a motor vehicle on a street or parking area or structure when said motor vehicl e is so constructed or loaded as to prevent the driver from obtaining a view of the street to the rear by looking backward from the d river's position unl ess such vehicle is equ ipped with a mirror so located as to reflect to the driver a view of the stree t to the rear of the said vehicle. Every com mercial ve hicle of one-h alf ton capacity or more, o perating upon the street, sha ll be equipped with two mirrors, one on each side, so adjusted that the o perator shall h ave a clear view of th e street behind such com m ercial vehicl e . - Size, weight, and load : No person shall drive or move or cause or know ingly permit to be driven or moved on a n y street any vehicle or vehicles of width , height, length or weight in excess of the limitations governing size a nd weight r estrictions specified in the Michigan Vehicle Code, Act 300, Public Acts of Michigan, 1949, as amended. 42.00- Traffic - Pedestrians .01 . 02 . 03 . 04 . 05 . 06 . 07 . 08 . 09 - Pedestrians shall be subj ect to traffic-co ntrol signals at inte rsections as provided for in Sections 34.0 12 , 34.014 , 34.016, 34.019 and 34.03 of this ordinance, a nd at all other places pedestrians shall be accorded the priv il eges and shall be subj ect to the restrictions stated in this section . - Pedestrian's right-of-way at crosswalks: Where traffic-control signals are not in place or in operation, the driver of a vehicle shall yield the right-of way to a pedestrian crossing the roadway within an y marked crosswa lk or within any unmark ed crosswalk at an intersection, except as otherwise provided in this section . - Whenever special p ed es tri a n-co ntrol signals ex hibiting th e words "Walk," "Don't Walk" or "Wait" are in place, such signals shall indicate as specified in Section 34.03 . - Between adjacent ii:,itersections at which traffic-control signals are in operation pedestrians sha ll not cross the roadway except in a marked cross walk . - A pedestrian shall yield the right-of-way to an emergency vehicle under the conditions prescribed in Section 4 7 .04 . - No pedestrian shall pass through , aro und , over or under any crossing gate or barrier at a railroad grade crossing or bridge while such gate or barrier is closed or is being opened or closed . - Pedestrians to use right half of crosswalk: Pedestrians shall move, when e ve r practicable, upon the right half of crosswalk . - Crossing roadway at right angles: No p e destrian shall, except in a m arked crosswalk, cross a roadway at any other place than by a route at right angles to the curb or by the shortest route to the opposite curb . - Crossing at other th a n crosswalks: Every pedestrian crossing a roadway at an y point other than within a marked crosswalk o r within _an unmarked crosswalk at a n intersec tion shall yield the right-of-way to all vehicles upon th e roadway . . 091 - A ny pedestrian crossin g a roadway at a poin t whel'<: a pedestrian tunnel or overhead pedestrian crossing has been provided shall yield the right-of way to all vehicles upon the roadway . - Walk on left side of roadway: Where sidewalks are provided, it shall be unlawful for pedestrians to walk upon the main traveled portion of th e . 10 36 42.10 .11 . 12 . 13 street or roadway. Where sidewalks are not provided, pedestrians shall , when practicable, walk on the left side of the street or highway facing traffic which passes nearest. - Pedestrians soliciting rides or business: No person shall stand in a road way for the purpose of soliciting a ride, employment or business from the occupant of a ny vehicle . - White canes: Any driver of a vehicle who approaches within 10 feet of a person wholly or partially blind, carrying a cane or walking stick which is white or white tipped with red , or being led by a guide dog wearing a harness and walking on either side of or slightly in front of said blind per son, shall immediately come to a full stop and take such precautions before proceeding as ma y be necessary to avoid accident or injury to the person wholly or partially blind . - When traffic control signals a1·e not in place or not in operation the driver of a vehicle shall yield the right of way, slowing down or stopping if need be to so yield, to a pedestrian crossing the roadway within a cross walk when the pedestrian is upon the half of the roadway upon which the vehicle is traveling, or when the pedestrian is approaching so closely from the opposite half of the roadway as to be in danger, but no pedestri an shall suddenly leave a curb or other place of safety and walk or run into the path of a vehicle, which is so close that it is impossible for the driver to yield. 43.00-Bicyclists - Traffic .01 . 02 . 03 . 04 - The term "bicycle" as used in this ordinance sh all mean and include any one or two-wheeled device having a wheel or wheels 16 inches or greater in diameter which is propelled by human power. The term "bicycle" as used in this ordinance shall not be deemed to include vehicles propelled by a motor or engine of any kind . - It shall be unlawful for any person to operate or leave unattended upon the campus any bicycle which does not bear a current and valid license or permit issued by the Michigan State University Department of Public Safety , the City of Lansing, or the City of East Lansing . - The permission to operate a bicycle in and upon the campus shall be evidenced by a permit tag to be designed by the Michigan State University Department of Public Safety. Such permit tag is to be made of metal or other durable composition and shall be issued by the Michigan State Uni versity Department of Public Safety after acceptance for filing of the appli cation for a permit. Each owner or owners of a bicycle shall, upon receiving a permit tag from the Department of Public Safety, cause the same to be affixed in a conspicuous place on the bicycle covered by said permit, pro vided , however, that the Michigan State University Department of Public Safety may , in their discretion, designate the particular place on each bi cycle where the permit tag shall be displayed by the owner or owners thereof. Such permit tags shall be displayed on each bicycle at all times when the same are being operated in and upon the campus . - Upon the sale or other transfer of a licensed bicycle by the owner or owners thereof, said owner or owners shall remove the permit tag and shall surrender the same to the Michigan State University Department of Public Safety: Provided , however, that said owner or owners, together with the transferee or vendee of said bicycle, may apply to the Michigan State Uni versity Department of Public Safety for the transfer of the registration of 37 43.04 said bicycle and the permit to operate same to the vendee or transferee, and upon such application to the Michigan State University Department of Public Safety shall then cause the registration of said bicycle and the per mit to operate the same to be placed in the name of the vendee or trans feree . - Application for a permit to operate a bicycle sha ll be made upon bring ing a bicycle not meeting the requirements of Section 43.02 of this ordinance upon the campus. For the convenience of the public, the Department of Public Safety sha ll provide for bicycle registration at some time during every day of the year except Saturdays, Sundays and holidays . - The Department of Public Safety shall take into its custody and impound any bicycle found upon the campus which is not properly registered or licensed as provided in this ordinance, or which is parked in violation of sections 43.17, 43.18, 43. 19, 43.20, 43.21, or 43 .22, and sha ll release such bicycle on ly after it shall be properly registered by its owner and a fee for its impoundment paid, or a summons issued to the owner for the alleged violation. The fee for impoundment shall be of such amount as shall reimburse the Un iversity for all costs of impounding and enforcing the provisions of this ordinance. Impounded bi cycles not claimed shall be auctioned and the proceeds of such auction applied to the cost of enforce ment and impo undm ent. - unless the same sha ll be equ ipped as hereinafter set forth: It sha ll be unlawful for any person to operate a bicycle on the campus . 05 . 06 .07 .071 - Every bicycle which is operated during the period from one-half hour after sunset to one- ha lf hour before sunrise shall be equipped with a n ac tivated white lamp on the front thereof, visi bl e under normal atmospheric cond itions from a distance of at least 300 feet in f rant of such bicycle, and shall also be equ ipped with a reflect mirror reflector or lamp on the rear, exhibiting a red light vis ibl e under like conditions from a distance of at least 200 feet to the rear of such bicycle; . 11 . 08 . 10 .09 . 12 .072 - Every bicycle shall be equipped with a suitable brake adequate to con trol the movement of and to stop said bicycle within a reasonable distance on a dry, smooth, hard-surfaced road . - No persons operating bicycles on the campus shall ride more than two abreast. - No person sha ll operate a bicycle at a speed faster than what is reason able and proper with regard to the safety of the operat01· and others . - No person operatin g a bicycle shall attach himself to any other moving vehicle . - Every person operating a bicycle shall accord the right-of-way to pedes trians crossing roads and streets on the campus at all intersections and crosswa lks . - The operator of a bicycle shall at no time remove both feet from the pedals thereof nor both hands from the handlebars or steering apparatus of said bicycle, nor shall any operator drive said bicycle in a careless or reckless manner or practice any acrobatic riding while said bicycle is being operated on the campus . - No operator of a bicycle shall cause the same to be driven upon or across any sidewalk or footpath situated on the campus or upon the campus grounds: Provided, however, that the operator of any bicycle may dis mount from such bicycle and proceed upon such sidewalks and footpaths on foot, pushing said bicycle while so proceeding on foot. - Every person operating a bicycle on a roadway on the campus sha ll be granted all of the rights and shall be subject to all of the duties applicable to the driver of a motor vehicle by the laws of the State of Michigan except . 13 .14 38 43.114 . 15 .16 . 17 . 18 . 19 . 20 . 21 . 22 . 23 insofar as the provisions of this ordinance for the operation of such bicycle shall conflict or modify said general laws which by their nature can have no application to the operation of bicycles . - Any person operating a bicycle upon a roadway on the campus shall obey the instructions of all official traffic-control signals, signs and other control devices applicable to motor vehicles unless otherwise directed by a public safety officer. - The Michigan State University Department of Public Safety shall as soon as may be practicable, lay out and establish upon the campus certain areas to be utilized as parking lots or areas for bicycles. T he Michigan State University Department of Public Safety, pursuant to the authorit y hereb) vested with them, sha ll establ ish a sulhcie ,11 nuniher of bicycle parking lot s to adequate ly accommodate the number of bic)Tles duly 1·egis1e red ;ind licensed under the provisions of this ordinance, and said bicycle parking lots and areas sha ll be estab lished at diverse appropriate places on the cam pus. In the establishing of said bicycle parking lots and areas, the Michigan State Un ivers ity Department of Public Safety sha ll consu lt and advise with the President of Michigan State University and the Landscape Architect of Michigan State University . - Upon the estab lishm ent of bicycle parking lots and areas as herein pro vided for, it shall be unlawful for the operator of a bicycle to cause the same to be parked in a ny place upon the campus outside of sa id bicycle parking lots and areas. In the event that bicycle parking racks are ava ilable in said parking lots and areas, the operator of a bicycle sha ll park such bicycle in the racks which may be provided. In the event that there are no racks pro vided or that the number of said racks is insufficient to accommodate him, the operator of a bicycle shall park his bicycle in an upright position within the confines of said parking lots or areas . - No bicycle shall be parked in any space designed and intended for use by motor vehicles unless such area sha ll be specifically allocated to bicycle parking by placement of a bicycle rack . - No bicycle in an inoperable cond ition , shall be parked on university property for a period longer than 48 hours. Any such inoperable bicycle shall be impounded by the Department of Public Safety and its owner shall pay the impoundment fee prescribed above to secure release of said bicycle . - No bicycle shall be parked and left unattended unless such bicycle is locked to a bicycle rack or imm obi lized with a locking device . - The Director of Public Safety is hereby authorized to publish special regulations providing for removal of bicycles from a bicycle parking area or areas and prohibiting bicycle parking in such area or areas for designated periods for ground maintenance and improvements or other university functions. Bicycles not removed from such areas or parked after the special regulations have been published shall be in violation of this ordinance and shall be impound ed as provided for in Section 43.0ti . - No person shall park any bicycle on the campus longer than 48 hours unless he is currently registered as a student, is emp loyed by the university or is currently residing on university property. Bicycles parked contrary to this provision shall be in violation of this ordinance and shall be impounded as provided for in Section 43.06 . - A person propelling a bicycle shall not ride other than upon or astride a permanent and regular seat attached to the bicycle. No bicycle shall be used lo carry more persons al one time than the number for which it is designed and equipped. 39 44.00-Accidents - Traffic .01 . 02 . 03 .04 .05 . 06 . 07 - Duty to stop at scene of accident involving death or personal injuries or damage to vehicles: The driver of any vehicle directly involved in an ac cident resulting in injury to or death to any person, or resulting in damage to a vehicle which is driven or attended by an y person shall immediately stop such vehicle at the scene of such accident or as close thereto as possible, but shall then forthwith return to and in every event remain at the scerie of the accident until he has fulfill ed the requirements of Sections 44.02, 44.03 or 44 .04. Every such stop shall be made without obstructing traffic more than is necessary . - Duty to give information and render aid: The driver of any vehicle in volved in an accident resulting in injury to or death of any person or dam age to any vehicle which is driven or attended by any person shall give his name, address, and the registration number of the vehicle he is driving and shall upon request exhibit his operator's or chauffeur's license to the person struck or the driver, or occupant of or person attending any vehicle col lided with and where practical shall render to any person injured in such accident reasonable assistance, including the making of arrangements for the transporation of such person to a physician, surgeon or hospital for medical or surgical treatment, if necessary , or if such transportation is requested by the injured person . - Duty to report accidents immediately: The driver of a vehicle involved in an accident resulting in injury or death to any person or any property damage shall by the quickest means of communication give notice of such accident to the Department of Public Safety. No vehicle involved in such accident shall be moved except when so ordered by a public safety officer. - When driver unable to report: Whenever the driver of a vehicle is phys ically incapable of making a required accident report and there was another occupant in the vehicle at the time of the accident capable of making a report, such occupant shall make or cause to be made said report. - Duty upon striking unattended vehicle, The driver of any vehicle which collides with any vehicle which is unattended shall immediately stop, and shall then and there either locate and notify the operator or owner of such vehicle of the name and address of the driver and owner of the vehicle strik ing the unattended vehicle, or if such person cannot be located, shall leave securely attached in a conspicuous place in the vehicle struck a written notice giving the name and address of the driver and of the owner of the vehicle doing the striking and a statement of the circumstances thereof, and shall report such accident as provided in Sections 44.03 or 44.04 of this ordinance . - Duty upon striking fixtures on a street or roadway: The driver of any vehicle involved in an accident resulting on ly in damage to fixtures legally upon or adjacent to a street shall take reasonable steps to locate and notify the owner or person in charge of such property of such fact, and of his name and address and of the registration number of the vehicle he is driv ing, and shall upon request exhibit his operator's or chauffeur's license and shall make a report of such accident as provided in Section 44.03 of this ordinance . - Garages to report: The person in charge of any garage or repair shop to which is brought any motor vehicle which shows evidence of having been involved in an accident, or struck by any bullet, shall report to the Depart ment of Public Safety immediately after such vehicle is received and before any repairs are made to such vehicle, giving the engine number, registration number, and the name and address of the owner and operator of such ve hicle, together with any other discernible information. 40 44.08 .08 - Accident reports confidential, All accident reports and supplemental reports requ ired of drivers of vehicles by Section 45.4 7 shall be without prejudice to the individual reporting, and shall be for the confidential use of the Department of Public Safety and the Commissioner of State Police, except that the Departme nt of Publi c Safety ma y disclose the identity of a person in volved in a n accid ent when such identity is not otherwise known or when such pe rson denies his prese nce at such acciden t. No such report shall be used as ev idence in any court action arising out of an accident, except that the De partment of Public Safety shall furnish, upo n d e mand o f any person who has or claims to have made suc h a report or upon demand of any cou rt, a certifi cate showing that a specifi ed accid ent re port has or has not bee n mad e to th e Department of Public Safety so lely to prove a compli ance or a failure to comp ly with the re4 uire mem that such a re port be made to the departm e nt. 45.00-Administration - Traffic .01 . 02 - Traffic Engineer (office): The office of Traffi c Engin ee r is hereby estab li shed. T he Traffic Engineer shall be ap pointed in a manne1· prescribed by the Board of Trustees an d shall exercise the powers a nd duties provided in this ordin a nce in a mann e r prescribed by the Board of Trustees and shall exercise the powers and duties provided in this ord in ance in a manne r consistent with prevailing traffic safety practices and in th e best'·interests of Michi ga n State Univers ity. In the absence of th e Traffic Engineer sa id duties and au thority shall be vested in th e Director of Public Safety or other officials as determ ined by th e Board of T rustees . - Traffic Enginee r (duties): !1 is the ge ne ral dut y or th e Tra lli c Engin ee r to determine the installation, proper timin g and maintenance of tra ffi c control devices ; to plan and direct th e opera tion of traffic on streets within the boundaries of Michigan State University; to establish parking areas therein; d esignatin g li mitation and use thereof; to install ap prop r iate signs implementing the provisions of thi s ordinance; to certify as to insta l lation, removal or authori zation of such devices and signs by posting same in the Administration Buildin g, Kellogg Ce nter, and the headquarters o f the Department of Publi c Safety or such o the r public places as may be d ee med appropri ate within the campus, accessible to the public includin g a map certificatio n illustratin g graphically the place ment and purpose th e reo f, for all such action s up to and including March 2, 1965; with all subsequent such actions by th e maintenance of a traffic comro l order (some times ca lled "work order") file . . 021 - Copies of traffic co ntrol o rder , certified by the Traffic Engineer to be a true transcript compared by him with the original in the headquarters of the Department o f Public Safety, shall be e vidence in all courts a nd pro ceedings in like manner as if the origi nal were produced. If it shall ap pear that a traffic contro l sign, sign a l, or d evice confo rmin g to the prov i sions of the o rdina nces was e rected or in place wh e n the alleged vio latio n of this ordinance occ urred, such showing shall be prima facie evide nce of th e existence of a lawful traffic control order authorizing such traffic con trol , sign or device, and it shall be unnecessary for the prosecution to affirmatively show the ex istence of a valid traffi c control ord er in such cases, unless and until such presumption is rebutted by co mpete nt ev ide nce . - Stop signs: The Traffic Engineer or Director of Public Safety is hereby a uthorized to determine and designate intersections where conditions war- . 03 41 45.03 rant the stopping of traffic and to determine whether vehicles shall stop at one or more entrances to any such intersection, and shall erect a stop sign at every place where he shall find a stop required, except at those intersec tions which are controlled by automatic signals or other traffic-control devices . - Stopping, standing or parking, The Traffic Engineer or Director of Public Safety is hereby authorized to prohibit or restr ict the stopping, stand ing or parking of veh icles on any street within the boundaries of Michigan State University and to erect signs giving notice thereof where, in his opin ion, such stopping, standing or parking of vehicles interferes with the move ment of traffic thereon . - Speed restrictions. The Traffic Engineer or Director of Public Safety is hereby authorized to establi sh , increase, or decrease the speed regulations provided in Sections 37.00-37.04 , and to erect signs giving notice thereof as follows: . 04 . 05 .051 - Establish prima facie lawfu l speed limits on highways outside of business or residential districts; .052 - Increase the prima facie speed limits on through highways within busi ness or residential districts; .053 . 06 . 07 Establish the prima facie speed limit in alleys and service drives . - One-way streets, roadways and alleys, The Traffic Engineer or Director of Public Safety is hereby authorized to designate one-way streets, road ways or alleys, and shall place and maintain signs givin g notice thereof, and no such regulation shall be effective unless such signs are in place. Signs indicatin g the direction of lawful traffic movement shall be placed at every intersection where movement of traffic in the opposite direction is prohibited . - Crosswalks, safety zones and traffic lanes, The Traffic Engineer or Direc tor of Public Safety is hereby authorized: .071 - To designate and maintain by appropriate devices, marks or lines upon the surface of the roadway within the jurisdiction of Michigan State Uni versity , crosswa lks al those places where he shall find that there is parti,cu lar danger to pedestrians crossing the roadway and when he shall further find that the existence of a crosswalk will reduce that danger; .072 - To establish safety zones of such kind and character and at such places where he shall find that there is particular danger to pedestrians and which are consistent with State law, and where he shall find that the existence of a safety zone wi ll reduce that danger; . 08 .073 - To mark lanes upon the roadway of any street where he shall find that a regular alignment of traffic is necessary in the interests of safety and effi ciency, or at such places as he may find to be advisable, consistent with this ordinance and State law . - Restricted turn signs, The Traffic Engineer or Director of Public Safety is hereby authorized to determ ine those streets or intersections of such streets from which drivers of vehicles shall not make a right, left or U turn, and shall place proper signs upon such streets and at such intersections. The making of such turns may be prohibited between the hours of any day and permitted at other hours, in which event the same shall be plainly indicated on the signs or they may be removed when such turns are unrestricted . - Turning markers, The Traffic Engineer or Director of Public Safety is authorized to place markers, buttons or signs within or adjacent to inter sections and thereby require and direct that a different course from that specified in this article be traveled by vehicles turning at an intersection, and when markers, buttons or signs are so placed, no driver of a vehicle . 09 42 45.09 . 10 . 11 . 12 . 13 . 14 shall turn a vehicle at an intersection other than as directed and required by such markers, buttons, or signs . - Through streets: The Traffic Engineer or Director of Public Safety is hereby authorized to designate through highways if stop signs are erected at the entrances thereto, subject to the approval of the State Highway Com mission if a State trunkline highway is involved . - Play streets: The Traffic Engineer or Director of Public Safety is hereby au thorized to declare and to establish, whenever he shall find that the pub lic safety and convenience are best served thereby, any street or part thereof a play street a nd to place appropriate signs and barricades enclosing the roadway . - Parking: The Traffic Engineer or Director of Public Safety shall de termine the location and nature of parking and tow-away zones, and shall erect and maintain appropriate signs indi cating the same and giving notice thereof, except that no such zones shall be established on State trunkline highways . - All-night parkinw The Traffic Engineer or Director of Public Safety when so a uthorized by the Board of Trustees may prohibit all-night park ing and erect signs giving notice thereof upon any street or portion thereof whenever in his opinion such prohibition is necessary or advisable in the interest of public safety . - Loading zones: The Traffic Engineer or Director of Public Safety is here by authorized to determine the location of passenger and freight loading zones and shall place and maintain appropriate signs indicating the same and stating the hours during which such zones shall be restricted for load mg purposes . . 141 - No loading zone shall hereafter be established unless a written applica tion for such zone is submitted to the Traffic Engineer or Director of Public Safety . . 15 . 16 . 142 - The application required herein shall not apply to the designation of loading zones in front of any public building, theater, school, church, hos pital or similar institutional building . - Public carrier stands: The Traffic Enginee1· or Director of Public Safety is hereby authorized to establish bus stops, bus stands, taxicab stands, and stands for other passenger common carrier motor vehicles on such public streets, in such places a nd in such number as he shall determine to be of the greatest benefit and convenience to the public. Every such bus stop, bus stand, taxicab stand or other stand shall be designated by a ppropriate signs which he may cause to be erected by the carrier for whom said stand is designated . - Metered par king zones in area: The Traffic Engineer or Director of Pub lic Safety is hereby authorized to determine and designate metered parking zones and to install and maintain as many parking meters as necessary in said metered parking zones where it is determined that the installation of parking meters shall be necessary to aid in the regulation, control and in spection of the parking of vehicles. The Traffic Engineer or Director of Public Safety is hereby authorized to determine or designate parking lots or areas which shall be controlled and restricted by parking gates and is authorized to install and maintain as many parking gates as may be neces sary in said areas where it is determined that the installation of parking gates shall be necessary to aid the regulation, control and inspection of the parking of vehicles . - Weight restrictions: The Traffic Engineer or Director of Public Safety is hereby authorized to prohibit the use of the roadway by trucks or other commercial vehicles and to impose limitations as to the weight thereof on . 17 43 45.17 . 18 designated streets where, in his opinio n , the public safety is concerned, but said prohibitions and limitations sha ll not become effective until notice thereof is g iv en by means of appropr iate signs placed o n such streets . - Emergency and experime ntal regulations: The Traffic Engineer o r Di rector of Public Safety is hereby empowered to establish all regulations necessary to make effective the provisions of this ord inance and to estab lish and enforce temporary or experimental regul ations consistent with this ordi nance, to cove r emergencies or special cond itions. No such regulation shall be effective and enfo rceable until and unless adequate signs, signals or other notices are erected clearly indicatin g said regulation. No such temporary or experimental regulation sha ll rema in in effect fo r more than 90 days . . 181 - The Traffic Engineer or Director of Public Safety may test tra ffi c-co ntrol .19 .20 .21 . 22 . 23 .24 devices under actual cond itions of traffic. - Traffic-control devices. The Traffic Engineer or Director of Publi c Safetv shall place and maintain or remove traffic-control signs, signals, lane mark ings and other devices and shall determine th e hours and days during which any traffic-control device shall be in operation or be in effect, when and as required under this ordinan ce to indicate a nd to carry o ut the provisions of said o rdinance, a nd ma y place a nd maintain such additional traffic-control devices as he may deem necessary to regulate traffic under this ordinance and under State law, to regula te, warn or gu ide traffic. - Manual and specificatio ns for traffic-con trol devices, Where possible , all traffic-control signs , signals an d devices shall co nform to the manu al a nd specifications as a pproved by the State Highway Department. - Limit to authority, Notwithstanding the au thority granted to the Traffic Engineer or Director o f Public Safety unde r this ordinance, no stop signs, pavement marking, buttons or any traffic-control d evice shall be erected or maintained upon any State trunkline under r.he ju risd iction of the State High way Comm ission without the latter's written permission . - Special traffic-control measures, The Traffic Engineer or Director of Public Safety is he reby empowered to establish special regulations for con trol of traffic for limited but regularly recurring pe riods of time such as occur during "rush hour" traffic co nditions a nd which extend for periods longer than the 90 days provided for in Section 45. I 8 . - The Director of Public Safety is he reby em powered to e mploy students or other special e mployees of th e De partme nt of Public Safety to be assigned to the co ntrol a nd direction of traffic. While e ngaged in directing traffic and while wearing d ev ices or emblems distinctivel y identifying them as e m ployees of the Department of Public Safety, such special employees shall be considered to be officers of Michigan State University a nd no motorist shall disregard the directions of such special e mplo yees whi le they are directing or controlling traffic. - Special parking privileges and restrictions. The Traffic Engineer or Director of Public Safety is hereby empowered to establish special, restricted parking areas (an d e rect signs which indica te such restrictions) where such restrictions are necessary for essential activities of the univers ity and/or where interference with such operations may adversely affect the public interest in main ta ining a safe a nd well-o rd ered co mmunity. Examples of such restricted areas, without excluding others , are hos pital park ing zones for physicians; parking zones for emerge ncy vehicles; parking zones for university vehicles; parking spaces rented by a nd reserved for specific in dividuals; parking areas prohibited to visitors; requirement that visitors park only in specific areas; and restrictio n of areas for ce rtain types of uni versity vehicle permits. 44 45:25 .25 . 26 . 27 .28 .29 . 30 . 31 . 32 . 33 . 34 - Mass transit regulation: The Director of Public Safety is hereby em powered to regulate the movement and operation of mass transit vehicles operating on university property including location of loading points, routes , schedules, vehicle capacity, provisions for passenger and public safety, unscheduled and charter operations, fares , safety inspection of vehicles, approval of drivers and other matters which will ensure a safe, efficient mass transit service to the university. No person shall operate any vehicle contrary to the provisions of such regulations, nor shall any manager or owner allow any vehicle under his supervision to be operated on univer sity property contrary to the provisions of such regulations . - The Traffic Engineer or Director of Public Safety is hereby empowered to establish lanes on streets for the exclusive use of bicycles and erect signs which indicate such usage. When such lanes are so provided and desig nated it shall be illegal for any motor vehicle to be driven within the bicycle lane area . - No person shall place, maintain or display upon or in view on any street, any unauthorized sign, signal, marking or device which purports to be, or is an imitation of or resembles a traffic-control device or railroad sign or sig nal, or which attempts to direct the movement of traffic, or which hides from view or interferes with the effectiveness of any traffic-control device or any railroad sign or signal. - No person shall place or maintain any commercial or political advertis ing upon any street, traffic sign or signal or parking meter. - Every such prohibited sign, signal, or marking is hereby declared to be a public nuisance and the Traffic Engineer or Director of Public Safety is hereby empowered to remove the same or cause it to be removed without notice . - No person shall establish private or departmental parking areas within the boundaries of Michigan State University unless permission is first se cured from the Traffic Engineer or Director of Public Safety . - Damage to traffic-control devices, No person shall attempt to or in fact alter, deface, injure, knock down or remove any traffic-control device . - Traffic law enforcement, It shall be the duty of the Director of Public Safety with such aid as may be rendered by other members of the Depart ment of Public Safety to enforce the provisions of this ordinance and the State vehicle laws applicable to traffic, to make arrests for traffic violations, to assist in the prosecution of persons charged with such violations, to in vestigate accidents, to cooperate with the Traffic Engineer and other officials in the administration of the traffic regulations and in developing ways and means to improve traffic conditions and to carry out those duties especially imposed by this ordinance and any amendments thereto . - The Director of Public Safety shall be responsible for the issuance of books of traffic citation and complaint forms and shall maintain or cause to be maintained a record of every such book and each set of citation and complaint forms contained herein issued to the individual members of the department and shall require and retain a receipt for every book so issued . - State law to the contrary, a public safety officer who halts a person for any violation other than for the purpose of giving him a warning or warning notice and does not take such person into custody under arrest, shall take the name, address and operator's license number of said person, the regis tered number of the motor vehicle involved and such other pertinent in formation as may be necessary, and shall issue to him in writing a traffic citation . Issuance of citation: Except when officially authorized or directed under · . 35 Notice on illegally parked vehicle: Whenever any motor vehicle without 45 45.35 driver is found parked or stopped in violation of any of the restrictions im posed by this ordinance or by State law, the officer finding such vehicle sfiafl take its registration number and may take any other information dis played on the vehicle which may identify its user, and shall conspicuously affix to such vehicle a traffic citation . - Disposition of citation: Every public safety officer upon issuing a traffic citation to an alleged violator of any provision of the motor vehicle laws of this State or of this ordinance shall submit the duplicate copies of the cor responding complaint to the Director of Public Safety or his authorized agent. - Illegal alteration or disposition of traffic citation: It shall be unlawful and official misconduct for any member of the Department of Public Safety or other officer or public employee to dispose of, alter or deface a traffic cita tion or anv copv of the conesponding comp laint or the record of the is suance or disposition of any traffic citation , complaint or warrant, in a man ner other than as required in this section . - Illegal cance ll ation of traffic citations or complaints : It shall be unlawful for any person to cancel or so licit the cancellation of any traffic citation or comp laint issued to an alleged vio lator of this ordinance . - Notice of impounding: Whenever an officer removes a vehicle from a street as authorized in Section 46.03, and the officer knows or is able to as certain the name and address of the owner thereof, such officer shall, within a reasonable period of time , give or cause to be given notice in writing to such owner of the fact of such removal, and the reasons therefore, and of the place to which such vehicle has been removed. In the event any such ve hicle is stored in a garage, a copy of such notice shall be given to the pro prietor of such garage . - Whenever an officer removes a vehicle from a street so authorized in Section 46.03 and does not know and is not able to ascertai n the name of the owner, or for any other reason is unable to give the notice to the owner as hereinbefore provided, and in the event the vehicle is not returned to the owner within a period of three days, then and in that event the officer shall, within a reasonable period of time, send or cause to be sent a written report of such removal by mail to the Commissioner of State Police, and sha ll file a copy of such notice with the proprietor of any garage in which the vehicle may be stored. Such notice shall include a complete description of the ve hicle, the date, time and place from which removed, the reasons for such removal and the name of the garage or place where the vehicle is stored . - Traffic violations: The Director of Public Safety or other officer of the Department of Public Safety designated by th e Director shall keep a record of all violations of the traffic regulations of Michigan State University except standing or parking violations, and of the State vehicle laws of which any person has been charged, together with a record of the final disposition of of all such alleged offenses. Such record shall be so maintained as to show the types of violations and the totals of each. Said record shall accumu late during at least a five-year period and from that time on the record shall be maintained complete for the most recent five-year period and in accord with existing Michigan Statutes . - Driver's record: The Department of Public Safety shall maintain a suit able record of all traffic accidents, warnings, arrests, convictions and com plaints reported for each driver, except those concerning standing or parking, which sha ll be filed alph abe ti call y under the name of the driver concerned; . 36 .37 . 38 . 39 .40 .41 .42 .421 - Such records shall accumu late during at least a five-year period and from that time on such records shall be maintained comp lete for at least 46 45.421 .43 the most recent five-year period . - Accident reports: The Department of Public Safety shall maintain a suitable system of filing traffic accident reports. Accident reports, or cards referring to them, shall be filed alphabetically by location. Such reports shall be available for the use and information of the Traffic Engineer; .431 - The Department of Public Safety shall receive and properly file all ac cident reports made to it under State law, or under any ordinance of Michi gan State University. The reports required by this ordinance shall not be available for use in any court action , but shall be available to governmental agencies for the purpose of furnishing statistical information as to the num ber and cause of accidents . - Copy of complaint: The Director of Public Safety shall maintain a file of one duplicate copy of the complaint corresponding to each traffic cita tion issued; . 44 .441 - The Director of Public Safety shall also maintain or cause to be main . 47 .46 .45 tained in connection with everv traffic citation issued bv a member of the Department of Public Safety a ~ecord of the disposition .of the charge . - Warrants: The Director of Public S.afety shall also maintain or cause to be maintained a record of all warrants issued on said traffic violation charges and which are delivered to the department for service, and of the final dis position of all such warrants . - Conduct of traffic accident studies: Whenever the accidents at any par ticular location become numerous, the Department of Publ i.c Safety shall cooperate with the Traffic Engineer in conducting studies of such accidents and determining remedial measures . - Preparation of accident reports: The Department of Public Safety shall secure from the Commissioner of State Police forms for accident reports required hereunder, and thereon shall report as prescribed by law . . 471 - Every law enforcement officer who, in the regular course of duty, in vestigates a motor vehicle accident of which report must be made as re quired in this ordinance, either at the time of and at the scene of the ac cident or thereafter by interview in g participants or witnesses shall promptly after completing such investigation forward a written report of such ac cident to the Department of Public Safety. It shall be the duty of all public safety officers to report to the Commissioner of State Police, on the forms provided, reports received of all accidents . - Traffic violation reports - available to public: All forms for records of violations and notices of violations which shall include traffic citations issued by public safety officers shall be serially numbered. For each month and year a written record shall be kept available to the public showing the disposal of all such forms, and such records, notices and reports shall be public records . - Annual traffic safety report, The Department of Public Safety shall an nually prepare a traffic report which shall be submitted to the Board of Trustees. Such report shall contain information on traffic matters as fol lows: . 49 .48 .491 - The number of traffic accidents, the number of persons killed, the num ber of persons injured, and other pertinent traffic accident data; .492 - The number of traffic accidents investigated and other pertinent data on the safety activities of the department; .493 - Plans and recommendations for future traffic enforcement activities. 46.00- Enforcement Officials -Authority .01 Direct traffic: Officers of the Department of Public Safety. or such special 47 46.01 officers as are assigned by the Director of Public Safety, are hereby author ized to direct all traffic by voice, hand or signal in conformance with traffic regulations provided that in the event of a fire or othe1· emergency or to ex pedite traffic or to safeguard pedestrians, officers of the Department of Public Safety may direct traffic as cond iti o ns may require , notwithstan din g the provisions of this ordinan ce; . 02 .011 - Members of the fire d e partment, when at the scene of a fire, may di rect or ass ist th e public safety officers in di1·ectin g traffic thereato r in the immed iate vicini ty . - Inspect vehicles. Any public safety officer is hereby authorized on reasonable grounds shown to stop any motor vehicle and inspec t the same, and if any defects in equipm e nt are found , to a rrest th e driver. - Impo und ve hicl es. Members of the Department of Public Safety are hereby authorized to remove a vehicle from a street, highway or parking area to the nearest garage or othe r pl ace of safety, or to a garage desig nated or maintained by th e Department of Public Safety, und er the circum stances hereinafter enumera ted : .03 .031 - When an y vehicle is left unattended upon a n y bridge, viaduct or cause way, or subway where such vehicle constitutes an obs tructio n to traffic; .032 - When a vehicle upo n a high way is so disab led as to co nstitute an obstruc tion to traffic a nd the person or per sons in charge of the vehicle are by reason of physical injury inca pacitated to such a n extent as to be unable to provide for its custody or removal; .033 - When a ny vehicle is left un attended upon a street or parkin g area and is so parked ill ega ll y as to constitute a d efin ite hazard or o bstruction to the normal movement of traffic; .034 - When a vehicle is found bei ng driven upon the streets and is not in prop e r condition to be driven; .035 - Wh e n a vehicle is left un attended upon a street co ntinuousl y for more than forty-eight hours and may be presumed to be abandoned; .036 - When the driver of such vehicl e is ta ken into custody by th e Department of Public Safety and such vehicle would thereby be left unatte nded upon the street; .037 - When removal is necessar y in the inte rest of public safety beca use of fire, fl ood, storm, snow or other emerge ncy reason; .038 - When a ny vehicle is left un atte nded in a ny parking area under such circumstances as to be presumed to be abando ned ; .039 - When any vehicle is found in violatio n a nd where it is determin ed that there are three or more outstanding violation citations agai nst the same vehicle. Such a vehicl e shall not be released from impoundment until there is satisfactory evidence that all o utstandin g citations re latin g to the ve hicle have been cleared with the Court; .0310- Wh en any vehicle is found parked in an area specifi ca ll y r eserved for vehicles bearing a ce rtain type of univers ity permit or in a parkin g space specifically reserved for the exclusive use of one vehicle; .0311- When a ny vehicle is found parked so as to o bstruct university operations . 04 or is parked on lawns or in shrubbery . - Req uest accident repo rts: The Department of Public Safety may require any driver of a vehicle in volved in an accident to fi le written reports and supplemental reports concern ing said accident, whenever th e origin al in formation is insufficien t in the op inion of the Department of Public Safety, and may requ ire witnesses of such accidents to render reports to the De partme nt of Public Safety. 48 4 7.00-Application - Traffic 47.00 .01 . 02 . 03 . 04 - No person shall wi llfull y fa il or refuse to comply with any lawful order or direction of any public safety ofiicer, or member of the fire depanmenL at the scene ofa fire, or any other person who is under this ordinance vested with authority to direct, control or regulate traffic . - The parent of any child and the g uard ian of any ward sha ll not authorize or kn owingly permit a ny suc h child o r ward to violate any of the provisions of this ord inan ce . - The regulations app licable to bicycles shall ap pl y whenever a bicycle is operated upon an y street or upon any pa th set as id e for the exclusive use of bicycles, subj ect to those exceptio ns stated her ein . - Exceptions : Authorized Emergency Vehicle. The driver of any author ized emergency ve hicle when responding to an emergency call , but not while returnin g therefrom, may exe rcise the privilege set forth in this sec tion , but subject to the co nditio ns herein stated . . 041 - Pa rk or stand, irrespective of the provisions of this ordinance; .042 - Proceed past a red or stop signal or sto p sig n, but only a fter slowi ng down as may be necessary for safe operation; .043 - Exceed the prima facie speed limits so long as he does not enda nger life or property; .044 - Disregard regulations govern in g direction of movement o r turning in specified direc tions ; .045 - The exemptions herein granted to an authorized e mergency veh icl e shall app ly on ly when th e driver of any said vehicle wh ile in motion so und s audible signal by bell , siren or exhaust whistle as may be reasonably neces sary, and when the vehicle is equipped with at least one lig hted lamp dis playing a Aas hing, oscill ating or rotating red or blue li ght visibl e under norm al atmospheric conditions from a distance of 500 fee t to the front of such vehicle, except that a n authorized emergency ve hicl e ope rated as a police vehicle need not be equ ipped with o r di sp lay a red or blue li g ht vis ib le from in front of the vehicle; .046 - The provisions of this ordinance sha ll not applJ to persons, teams, motor vehicles and other equipm e nt while actually engaged in work upon the sur face of a street bu t sha ll appl y to such perso ns a nd vehicles when traveling to or from such work . - Preferential Ri ght-of-W ay : . 05 .051 - U po n the immed ia te approach of an authorized emergency veh ic le equipped with at least one li ghted fl ashin g, rotating or oscill ating la mp ex hibiting red o r blue light visible und er no rma l a tmosph er ic conditions from a distance of 500 feet to th e front of such vehicl e, and when the driver is giving a udible signal by siren, ex ha ust whistle o r bell, th e driver of ever y other vehicle shall yield the ri ght-of-way and shall immed iate ly drive to a position para llel to, and as close as possible to the ri ght edge or curb of the roadway (or left edge o n a one-way street) clear of a ny intersection a nd shall sto p and remain in such position until th e a uthorized emer gency ve h icle has passed , except when otherwise directed by a public safety officer; .052 - All motor vehicl es forming a funeral process ion wh en going to any place o f buria l, and oth e r au thori zed process io n, sha ll have the right-of-way over all other vehicles exce pt fire apparatus, ambula nces a nd police ve hicles, at any street intersection: Provided, that each vehicle in a fune ra l proces sion shall have displayed on the front thereof a Rag which shall be white in co lor, a nd upo n which shall be printed, sta mped or stained a purple cross or the Star of David. 49 48.00 48.00-Washing Vehicles .01 . 02 - No person shall attach a hose to any unive rsi ty water supp ly for th e purpos e of washing non-unive rsity owned ve hicles . - This does not prohibit th e washing of ve hicl es throu gh th e use of a pail o r similar co ntain er. 49.00- Wildlife .01 - All lands a nd wa ter under co ntrol of a nd governed by said Board are designated as a wildlife, fish and bird sanctuary and the shooting or taking o r moles ting of birds, fish or wildlife is he reby prohibited. 50.00-Severance Provision .01 - If any provision of this ordin a nce or part th ereof sha ll be adjudged in va lid by a court of competent jurisdiction , then such adjudication sha ll not affect the validity of this ordinance as a whole or a n y provision or part thereof not so adjudged invalid. 50 * 100% Recycled Paper
